Am I entitled to a refund/exchange ?

Hi, Sorry if this is in the wrong place but I couldnt figure out where to put it. Last week I took my son to spend some of his christmas money, we went to GAME to look for a Dragonball Z ps2 game. He found the game he wanted in the pre-owned section for £14.99 so he bought it. I told him to check it he did and it worked fine however over a few days as he has got better at playing it and moving further into the game it gets to a point where it 'freezes' and wont go any further. The shop has refused to exchange because I dont have a reciept but I did have a bank statement with the transaction on. Should I go back tomorrow and argue my case or am I entitled to nothing.     You have proof of purchase (ie your bank statement) therefore as they have an electronic till system they should be able to match up the 2 transactions there should not be a problem.It would help if you could say the approx time you bought it and who served you, as a manager this sometimes made the difference about whether or not we could track a missing reciept.
    Hope this helps but do stand your ground it isn't shakey.

    Oh I forgot to mention, I have printed off advise from the office of fair trading website which does state that a missing reciept on faulty goods means nothing!

    I had a friend who worked in game & I recall him saying they were rubbish as far as faulty second hand goods go - they have something pathetic like a 7-day guarantee if I recall correctly?
    If you don't get your way make a fuss & be charming & fingers crossed they'll sort things out in order to get rid of you :D

  • Don't Game mark their preowned stock with permanent markers? Check the disk and the box, should be proof enough with the bank statement that it came from there.

    Hi, Cant see any permanent marker however both the box and instructions have got the 'pre owned' stickers on and the 'game' barcodes
  • Under the terms of the Sale of Goods Act, you are entitled to a refund, exchange or repair if the goods are not of "satisfactory quality". In your case, as the seller sold you the game "in the course of business" i.e. they are a shop that sells computer games, the item must still be of satisfactory quality even if it is second hand (the same rights do not exist if you buy the item from a private seller). Take the game back to the shop, tell them you have proof of purchase in the form of your bank statement and request a full refund. If they refuse, tell them they are in breach of section 14(2) of the Sale of Goods Act and you will make a complaint to the local Trading Standards office if they do not comply. If they still won't budge, take your purchase to Trading Standards, who will be only to happy to write a nice letter on your behalf, or help you write one. From what you have said, there is no grey area in this instance, Game are simply guilty of failing to comply with their statutory obligations, by failing to provide you with a refund.

    Just an update. I went back to the shop today with a copy of my bank statement and also a copy of the rules on the office of fair trade website. The manager at first refused to exchange which was what I wanted but as soon as produced the fair trade paperwork he advised the sales assistant to exchange so a result! Thanks for all of your help.
