Redundancy Calculation Question

OH is being made redundant on Monday 22 August :( - redundancy package is 5 weeks PILON (not working notice and tax free) and 5 years redundancy pay.

My question is that he is currently aged 43 and will be 44 on 4 September (less than 5 weeks away), the difference in the redundancy pay between those ages is another 0.5 weeks pay. Will OH’s forthcoming birthday be taken into account when employer is calculating his redundancy pay or do they not have to take this into account because they are paying PILON and his employment contract effectively ends on Monday?

    You add statutory notice to the date of notice to find the date to be used for redundancy(you count back full years).

    Some employers will use the temination date and add the statutory notice to that.
