Excel parking charge please confirm to ignore???

Options
:cool:I parked and paid for ticket. Upon return to car penalty notice !

I appealed to Excel as the ticket had fallen onto the 2nd dashboard of a Citroen Picasso and was not visable as slipped behind an envelope I needed to post.

I appealled within 7 days they received appeal on the 8th day posted 1st class recorded so ..... they are now charging me £60 instead of £30!

I am not wanting to pay I also sent copy of ticket purchased.

I have looked at photographic evidence and they have taken pictures of the large dashboard but no picture of the smaller dashboard. You reckon this some amunition???

Feel like sending letter with another copy of ticket and photo of car dashboard layout and also advising I was not driving that day.

Car is registered to me but husband was driving.

Help and comments MUCH APPRECIATED PLEASE

Been reading lots of threads for advise over last 2 hours but will still like some comments on my situation

  • the ticket also states my registration number and cctv would confirm I left well before the expiry time
  • Unfortunately the big mistake you made was appealing in the first place as they will think they got the fish on the hook.

You should have never entered into any correspondence with them then they would have had no chance of pursuing you and you would have just received a chain of worthless threatening letters.

If they do not know who was driving then their cause is much more difficult as the registered keeper is not obliged to say who was driving at the time and their so called contract is with the driver at the time.
  • I know I realised that after reading previous threads and quotes ;(

Just ignore everything from now on :) They know you have the correct ticket so there is ZERO chance of them using the courts, despite their "threats"
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

save the ticket in a locked safe, ignore everything and if you get Stamped Court papers, which I doubt, then take the ticket along to court and put in a bill for your expenses.

If the following helps ease your worries, I'll be glad:

    1) Their so-called Photgraphic Evidence does not incriminate you. It may prove that your antagonist (Excel) is correct in what it claims you did but none of this warrants its demand, neither £30, £60 nor anything. A landowner can sue for actual losses. To this end, neither Excel, its phony "debt collectors" nor the landowner will go near a court.

    2) Yes you are 101% safe to ignore. Never mind having appealed, it should really dawn on people that they are dealing with a business and not an authority, and that business also happens to be the medium to which you appeal. When you think about it, it's senseless. The whole racket is one major scam and no matter how official some of these letters look, they are empty threats and are unlawful in the first place. Once you familiarise yourself with the addresses of your pursuers, you can start rejecting them and confining them back to the letterbox, marked "refused".
  • great advice folks thank you

    also read somewhere....

The advice in the Telegraph's motoring section is to write and tell them you were not driving and you are under no legal obligation to tell them who was- their dispute is with the driver not the keeper. They also suggest you enclose a cheque for £5 as settlement 'for a minor breach of contract'. If they want anything else they will have to take you to court and they won't be bothered to do it, especially as you have made a reasonable contribution.

My husband was driving that day not that I would say you reckon worth doing the above????

That is a British journal not being rebellious and trying to be amicable. If you want, do that. But I tell you there is no need: they cannot do court. They've tried in the past, some of them, and the courts have dismissed it. I'm not sure you or your husband realise that the PPC game is a total scam.

In addition, you don't need to write to say you were not driving. It is not advised if it were the case that you were driving but who really cares? What you have admitted in your appeal cannot be withdrawn, however, if they bought your details from the DVLA, they could only approach you as keeper, and it is as keeper you have no obligation to give them clues. Best way, keep them in the dark, especially if it is ammunition you want!

That advice by Lucy Bonham-Carter has long since been recognized as being a waste of time.

Remember we are dealing with companies set up with the intention of parting your hard earned from you. Any payment could be deemed as an acceptance of their authority.

I believe now although she has now gone over to the darkside Lucy B-C says ignore them!!

Beside why pay again you have already and the thing is so do Excel, yet they still try it on.

the Art of getting that few quid you sweated and broke your back from your pockets without actually having to sweat and work has always been the art of the scammer. Why work if you can get some other idiot to do it and then give you their wages.
Only the type of scam changes and fake parking tickets are the latests crooks, thieves and liars trick to part the gormless with hard earned cash .
