Newby! Please help - Marston Enforcement

I'm new to the site and wondered if there are any users who could possibly help me with my problem. I'm a single mum with 2 kids working 16 hours and in receipt of working tax credit.

I had a motoring fine which I had been paying off monthly and I'd missed a payment, totally forgot about it - I recall the amount being outstanding as £32 ish, so at the first available opportunity (I'm paid monthly) I paid £33 knowing the debt was now cleared. Six weeks later I came home to a hand delivered letter from Marston claiming I now owed £307 as the debt had been handed over to them. I called Marsden immediately and informed them the debt had been cleared. The person on the other end of the phone practically called me a liar saying yeah...so YOU say. You need to call HMCS and get them to verify this. Called HMRC who said they did have a debt outstanding on their system and asked if I had any evidence to prove I had paid, I did and agreed to send the copy confirmation from the post office to them asap. I did this the following day by fax from work, I enclosed a photocopy of the receipt and also my payment card along with a letter stating the debt had been cleared and asking for the database to be updated.I also copied Marston in on the fax for information thinking the matter would now be closed.

A week later, Marston delivered another letter stating they were issuing me with a distress notice if I didnt pay. I emailed HMRC who informed me the debt had been passed to Marston before I had made the final payment and although the debt had been paid (directly to HMRC) Marston were entitled to be paid their fees...

This morning I came down to a hand delivered letter stating that a representative had called....I was up at 8.30am and my doorbell would wake the dead - it's clear that he/she did not knock or ring the bell, also there is no time or date on the envelope in the "left at / on " portion of the envelope.

The letter is a removal notice, stating the client is HMRC and the "Offence" is a distress warrant and I now owe fine and fees of £275.00 .

"Due to your failure to pay an outstanding magistrates fine an officer has attended premises to arrange payment or the removal of your goods.. Further notice prior to removal is not legally required..."


What can I do? I don't owe HMRC who recognise this fact. Is the person a bailiff or a doorstep collector, can he seize my car (it's on HP) I'm worried sick and don't know what to do.

    He is a court appointed bailiff, not a debt collector.

    No, they cannot take the car, it doesn't belong to you.

    Go to http://www.bailiffadviceonline.co.uk/ I think it costs about £10 to join, but given what you have to lose, I think £10 is very reasonable.

    I have never used this site, but have read on here that it is meant to be very good and well worth the money.

    What has HMRC got to do with a motoring fine, as HMRC is tax?

    I suspect that is a typo and should read HMCS. Seeing as the OP seems to be under a good deal of stress, it is understandable.
