Need urgent advice... wish i had read up on parking eye before replying to them!!!!

This is exactly the same thing that happened to me, with our begrudgingly-gained mutual friend Parking Eye. I also made the error of emailing, but was cautious to not use the word appeal (it was in fact a short and sweet statement informing them we had purchased a ticket). The fact is that you, like I, have fallen victim to this bunch of con-artists but luckily, we were both smart enough to Google them (unfortunately, I suspect many don't and just cough up).
But the facts are that under English contract law, all that a private parking company can sue another citizen for is for actual losses incurred... as you, like I, paid for the time we were actually parked in one of the sites that Parking Eye purport to manage, their clients suffered absolutely no fiscal losses whatsoever. Therefore, we "owe" them nothing. Private companies cannot issue penalties, and Parking Eye's figures plucked randomly from the air are, in fact, de facto penalties and are, as such, ILLEGAL and UNENFORCEABLE. That's why parking companies never go to court.... in the past, judges have found against them on the simple fact that under contract law, private companies cannot penalise another private individual.
I'm a little ahead of you on the series of threats that they send in the post, but we both have the pleasure now of being able to receive letters from them safe in the knowledge that they are wholly meaningless and it costs the company money every time.
Keep the parking ticket, I still have mine, in a pile of scrap paper from Parking Eye. Read the Sticky at the top of this forum so that you know in advance what's coming in the post. And keep researching on this forum and elsewhere.... you'll soon become increasingly clued-up about this scam and confident about ignoring this bunch of brain-dead f****** idiots.
Relax. Ignore. Smile!
I was actually very close to paying up... but now I'm really glad that researched them and came across this forum *phew*
Just out of curiosity, did you type in the incorrect vehicle registration number like me????0 -

This forum is correct and current with our 'ignore' advice. The templates are old and pointless, stop looking at the main site and stick with this forum board.
Please tell me you are not about to send any letter to a scammer, surely you are not going to waste your time and money? Do you reply to phishing emails as well that tell you that you've won the Nigerian Lottery?
It's not a fine, ignore it. But you and your Mum need to do a bit of reading to be ready for the scary letters, which you also file in a drawer marked 'ignore, scam'!
Here's the first page of the current forum posts, almost all about private parking co's (known as PPCs to us). Did you realise how much current info is here on MSE on every subject, there's a whole new page of 'PPC scam' posts every single day. It's not just this thread on the subject! :
You and Mum should read/refer to the permanent sticky thread 'PPC letters' at the top, for your preview of the rubbish they will send to the registered keeper. And please both read 'welcome, please read before posting' (LOL!) to see the advice and to click on the must-see Watchdog link. Your Mum simply must watch that, I promise you it will change her mind. Then just choose any other lower down threads at random, read any which are not about real Council PCNs.
You will soon understand why this is no 'parking ticket'.

Just watched the watchdog link... feel much better now0 -
My vehicle registration number in private car-parks which needs registration entered is A123 BCD, I've paid for my ticket therefore the landowner can't sue me for damages cos he/she suffered nothing.
Just ignore Parking Spy, they are as much use as a chocolate fire-guard0 -

Yeah. They had some ridiculous machine, and I had neither the patience or inclination to figure it out. So I just stuck in two random numbers when I got the ticket as opposed to the proper reg number. Don't worry though, they won't pursue it to court, because like I said the amounts requested constitute penalties and no judge would find in their favour. But also, the fact we have tickets proves we paid even if it doesn't have our reg on them. Court cases are decided on what is known as the burden of proof, and in civil matters (which it is when a private company sues another individual) the burden of proof required is "on the balance of probabilities". So, if it went to court, a judge would find that it is sufficiently likely that the ticket we possess, even if it does not have our full reg on them, was produced in response to payments that we made for parking. Despite what a company like Parking Eye might like to claim, any judge with half a brain would rule that the tickets we possess were produced in return for monies paid and it is far from likely that an individual would resort to scouring a car park for old tickets just to defend ourselves against a claim from a PPC. Therefore, we paid for parking, no losses were incurred and NO MONEY is owed. Parking Eye can swivel for anything from me, and I trust that you will follow suit!
If you see what I mean!0 -
Only the landowner can sue for damages, not a 3rd party.0
