Bumped by the gym!

Hello all this is my first post, i hope i'm posting in the correct section.

So I joined this gym under the impression it was £55 every three months, the man sat there and listened to me go on about i worked out how much it is per month and its very good, blah blah. My fault in this is i didn't look at the agreement properly and it is PER month.
After receiving my email confirmation i noticed it was per month £55 , i called and I tried to speak to him and explain, i even mentioned he didn't say anything when i was harping on about how good the deal was; he in turn got very rude and started shouting and said i cannot cancel, until after the three months is up; so i have to pay them over £150 first before i can cancel my direct debit!

My question is what can i do about this, i cant afford that. :cry:

    I think you've hit the nail on the head here as you didn't listen properly to what he was saying and you didn't read the legal document before signing it.

    What lead you to believe it was per quarter rather than per month?

    because he and his previous colleague had said its a three month contract so every three months you pay £55.

    Also, the payments do not start until September, my membership started on Sunday, they gave me a deal where i get August free, but due to illness i havent used it as yet

    I don't think there is anything you can do, you've signed up for a 3 month contract at £55 a month, misunderstanding him though unfortunate is no basis to cancel a contract. I would treat this as a lesson and in future be more careful about signing up to things!

    Its unluckly though and I imagine pretty irritating! Some places have a 3 month notice so I would cancel now, pay the 3 months and then walk away.

    These are the telling points in your post, unfortunately. An expensive lesson learnt I think this time. Cancel now but you're going to have to pay for the first three months :(

    As I am currently in a free trial until end of August (which I haven't even used as yet) and the payments do not start until september, can't I just email them saying I'm leaving and then cancel me DD with my bank?

    The fact you haven't used it yet is irrelevant i'm afraid. The service is still there for you to use.

    Do they have a cancellation period or anything? If not then no you can't as you have signed a contrract and bound by those terms. Cancelling a DD doesn't give you a way our of the contract -- it just means they will send it to debt collectors.

    An expensive lesson now learnt.

    It depends what the contract / details say. If it is a "free trial" then why did you need to sign up and commit for 3 months?

    If it says "free trial" if you sign up, then you may well be able to cancel.

    The real problem is that no-one can give any decent advice without accurate knowledge of the contract / material used when you took the deal.

    Is it a chain? Do you have a link to the offer? :cool:

    If you can PROVE that you have been misrepresented, then you have recourse. If not, you are a bit stuck.
