    It will help if OP has to sue LL to recover the money LL paid/should have paid to council for CT, but it will not stop council chasing OP for CT, if at a later date they find out OP was liable for the CT.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • Yes I will be keeping hold of them definitely. I have every bill from the landlord for the 2 years I have been here.

    made a mistake in my original post - there are 4 flats not 3. always forget the upstairs one as the tenant never seems to be there! the council tax is £25 per month, which means its £100 for the whole property and each flat pays a quarter. Surely it would be a lot more than that if the flats were listed seperately as they should be?
  • The house is in the landlords name though and all the bills. How would they know any of the tenants were even living here? Nothing is in my name or any of the other tenants.

    Sounds like they aren't listed - the full council tax on each flat should be £100 + per month.

    I've seen plenty of these cases.

    If the VOA band them then the owner will be billed until he provides the occupiers details - not surprisingly the owner tends to provide the details very very quickly and the occupiers get large bills.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    All he has to do is to give the council proof of your occupancy and they will trace you - most likely along with the Liability Order from the magistrates court (all they are required to do is to send all paperwork to the last known address).
