Joint Mortgage -Problems

I dont know if anyone can give me advice. I bought a house with my partner in 2008, we now have 2 children together, he left us in August 2010,since then I have recieved only 4 payments for maintenance for the children and a pittance towards the mortgage. I have struggled to pay the mortgage so have gone back to work full time, I have now paid the mortgage alone since January 2011, he still has his name on the mortgage as I cant afford to get his name taken off. Is there any kind of legal paper work I can get that states I am the one who has been paying the mortgage alone so that he cant claim anything back if we sell the property, we are in negative equity because of the fall in house prices so it would be a while off yet, I just dont see why i should keep paying the full amount for the mortgage while he doesnt work and provide for his family and then get a payout if/when we sell.
