    if they have a history of never taking people to court, then fine ignore, but if you broke the rules of parking and they have evidence, then it it still legally correct that they can take you to court and win, dont think ignoring it is guaranteed to work. there will be some people who believe this then get a shock when they get a ccj or something.
    the invoice isnt illegal, but neither is it a legally binding fine!

    Yes they can technically win in court if they can prove their charges are actual damages endured by the landowner (for example a private P+D car-park where the driver doesn't buy a £1 ticket for 1 hour) and not unlawful penalties.

    There is no shock with CCJs
    1 - The PPC has to do court
    2 - They have to win
    3 - You refuse to pay what then judge orders within 28 days

    What 'rules' do you mean? There are no 'rules' to be broken. You park your car, pay for a ticket if required, that's it!

    A PPC can try and take the case to court but they won't because they won't win and they know it! They could only try to claim damages for the landowner, which is literally pennies and certainly nowhere near the £60 or whatever that is the norm. That would be seen in the eyes of the judge as an unlawful penalty.

    And nobody will get a CCJ, unless it goes to court (unlikely), the PPC win (very unlikely), then the defendant doesn't pay up (very very unlikely) and the the PPC go back to court to apply for a CCJ (very very very unlikely).

    Scaremongering with inaccurate information does not help anyone.

    They have a contract to use the gym I bet it wasn't stated they could only use it for 3 hours! Then they get charged £90 for car parking?
    If they want to change a contract they have to ask if you wish to accept or they cancel!

    £90 for ten minutes over so a PPC can take you to court and justify parking charges of £540 per hour?

    Hi,On Friday 19.08.2011 I received a Parking Charge Notice from CPS Midlands,I had a car on private car park,I went to the shop and when I come back I saw the Notice on my windscreen.From about 2 years I left my car on this car park and yesterday I received Notice.I need to pay 75£ up to seven days because after 7 days they will give me another 50£.Please help me what I can do now???I need to pay it?I have a receipt from shop-time 14.47 but the time of Notice is 14.35 becouse first I was in shop outside this car park. What I can do.Please help me.

    read the previous posts please. would you give someone a parking fine for parking out side your house and expect them to pay???? same difference!!!!! ignore. ignore. ignore.

    our local morrison has just introduced parking machines ( used to be had to spend over £5 and get parking free) and on the first day a friend got a ticket. the machines are carefully hidden away in corners. told her to ignore it but dont know if she did. hope she did.

    Many thanks for everyone who replied to my post, though I am a bit worried by Dave101t's advice, as I would not want to risk ignoring my fine if there's a chance I could end up getting taken to court. I could really do without the stress. The irony is that I go to the gym to unwind from stress and now have to spend the whole time I'm in there worrying about making sure I leave on time, and then last week because the gym's clock was wrong, I did leave a few minutes late and got a 90 quid parking charge!

    Thanks also for the people who said make sure I read all the postings. I have spent a couple of hours doing that and felt reassured that if I was just in normal pay&display car park then I could ignore this fine, but my situation is a bit different and I couldn't find another posting about the same kind of situation. I had been informed by my gym back in April that this system is in place and you have to put your registration number into a computer when you enter the gym. Therefore the gym tells me that I was aware of the parking limit of 3 hours and should have left on time. I had thought they might help get the ticket cancelled, but they are not willing to help at all and just say the car park is 'nothing to do with them' - which is ridiculous since they own it! They have invited this 'private eye' company to put their cameras in their car park and send people fines, so surely it is ultimately down to the gym ? But they won't help and so I am thinking of cancelling my membership. But am still unsure whether I have to pay the fine or not? Could the gym side with the parking company and take the #90 of me by direct debit along with my gym fees?

    Something that does occur to me though is that when I joined the gym back in 2000 there was no parking time limit to the car park at all, so I don't think my contract would state that I agree to this limit or the fine for over-running it. Also, other posts say that the ppc can only try to claim back losses in the courts which amount to the cost of an unpaid ticket, but since there is no charge to stay in the fitness first car park, how can they do this? I have not caused any financial loss to Fitness First by over-staying by 5 minutes in their car park, so does that mean they will not bother taking me to court? I just need to know for sure before I ignore this fine. Please can someone clarify the legal situation for a car park that has no parking charge, but where you sign in when you enter and 'agree' to a time limit and then exceed it?
  • You are worrying needlessly. I do not know Dave101t's motive but I am sure it is not to provide sensible advice. I can only speak for myself but I can tell people to ignore the bogus fines of these scammers because I have done so on several occasions and never been taken to court. These charges have no legal validity and so the chances of being taken to court equate to winning the lottery. Why are you scared on what the gym will do, for a start they cannot dip into your bank account to collect money that is not owed to them. The second point is as a customer, your should demand satisfaction and be prepared to take your custom elsewhere. Personally I would not put up with this nonsense, I would vote with my money and find a different gym that understands customer service.
    Still waiting for Parking Eye to send the court summons! Make my day!

    Parking eye can be ignored I very nearly begged them to take me to court a couple of years ago, they did not take my challenge! As for Dave101t's post, I think I have worked out what the "T" on the end of his username stands for!!:p

    One thing you could do is tell the gym that as they have changed the conditions of your membership they can get the ticket cancelled or they can cancel your membership and go somewhere else!
