E-petition to force clampers to pay ccj's

I've put the link in another post but it could be hidden there. I know its a long shot but if it highlights this loophole then they may do something about it in the Freedoms Bill.

    Strange is it not that you can be made bankrupt for as little as £750 and you are banned from being a company director, yet you can have a £1,000,000 in unpaid CCJ's and carry on.

    Also if I is late with a tax or VAT return I pay a penalty, but I could ignore a CCJ.
    Suppose the only way of getting to them is sue them as an individual as long as you can find who they are, at least then their credit rating gets a wallop!

    Isn't the easier solution simply to instruct Court Bailiffs to retrieve goods to the value of the CCJ?

    It is an additional cost to pay, but which is added to the costs claimed anyway. Hvaing gone so far through the courts to get a CCJ, seems odd to then not pay anymore to get the cash from the culprits.

    I guess if the CCJ is for only £150 or whatever, the idea of additonal costs simply puts some people off bothering.....but that is why clampers and their kind get asway with it, they rely on apathy.

    Clampers have no assets - just a van and some clamps. Maybe a computer in their office, if you can find it.

    You can only get money off them if you follow them at work and jump in when a victim pays some cash. But doing that can turn ugly.

    As Alexis says they just hide their assets. Most of them don't even have the business in their name. Then when they have a few CCJ.s they just phoenix!

    Unfortunately, many clampers operate on land with which they have no connection without the authority of any landowner or managing agent, knowing the police will insist "it's a civil matter" regardless.

    In addition, it can be very difficult to hold the managing agent responsible, with many judges ruling that they are not liable for the actions of their actions.

    Hence, the only current effective remedy for an unlawful clamping is the use of angle-grinders; since 'paying and suing' is throwing good money after bad and since no other viable alternative exists, I would say there is clearly a "lawful excuse" for what would otherwise be "criminal damage".
