Refurbished products-What are my rights??

I bought a Humax PVR from an online retailer. After 3 months the product began freezing. I orginally contacted the manufacturers technical support assuming it needed a software update but after trying what they suggested and eventuallly not being able to even turn the product on they told me it was faulty but would only offer me a reconditioned/refurbished unit. I contacted the retailer who refused a refund. I then tried to get a refund via my credit card as suggested on this website but they said they could not help either.

What I would like to know is, if I accept the reconditioned unit, what are my rights if this becomes faulty or the product is not in the same condition as my original (except working obviously) as I only had it several months and spent over £300 on it!

    I've had dealings with Humax technical support team over the past 6 months and found them only helpful. I've had two replacements units sent out by them direct to the retailer (problem is on a thread here somewhere) and they were very good.

    If the machine is only 3 months old I can't understand them only offering a refurbished replacement. So, sorry, can't help as my experience is very different.

    The retailer is under no obligation to refund. If the item is inherently faulty they must replace, repair or refund -- their choice. And within the first 6 months it is the retailer who has to prove otherwise.

    If your not happy with a refurbished one (not sure I would be if it was brand new) then stop dealing with the manufacturer and send the retailer an email asking for a remedy under Sales of Goods Act.

    You may have expectations that a refurbished unit is going to be scratched and horrible, and barely working, as if it's a poorly patched up piece of machinery.

    That's not the case. The vast majority of refurbs are indistinguishable from boxed ones, except that they will have been opened up and had the faulty component replaced with a new one.

    You will still have the same rights as if you'd bought something new, and a good seller will continue with your warranty.

    I presume for that price it would be the 1TB fox t2? They're usually really reliable from what I've seen, so hopefully you wont have any more problems.

    If I know my warranty will be the same as the original and it looks as good as a new one, I am not concerned about having a refurbished/reconditioned unit. My original was a brand new one though.

    I do not understand how the retailer can refuse any responsibility after 30 days though. I wouldn't recommend the retailer, also had issues with the despatch too.

    Yes 1TB fox t2 was what I bought, and chose this because I had read good reviews. When it worked it was great so looking forward to receiving my replacement next week!
