eBay seller waited auction to finish to say "I don't have it anymore".. What to do?

Hi, I'm after some advise please

Basically, I won an item which I paid straight away using paypal

As soon as the auction ended I got an email outside email saying he had lost it and I could open a case.

Via eBay message, I asked him to just refund me.

Well, he did and also via ebay system he's asking me to cancel the transaction.

Now what really annoys me is the fact that the same item was on eBay the week before with a Buy it Now (5x more what I paid) and it did not sell.

I'm 100% sure he lied about the item being lost. He would accept it went cheap and he didn't get much for it. He also has a couple of negative feedback about cancelling/wanting more money for items.

Now that I got my money back should I:

- leave negative feedback?
- accept the transaction cancellation
- leave it opened (I believe by cancelling it he'll have to pay the fees)?

    leave neg to tell others what he does
    as you won he would have been charged the FVF, if you cancel this he will get these back

    Should I leave it open then and let him to cancel it in a week time?

    You get an option saying you don't agree to the cancellation. Select that.

    Don't agree to the cancellation, but you must respond to the case, refusing the cancellation, then he has to pay his fees still.
    Leave approriate neg FB.
    I expect if it had gone for the amount he had listed it for last week it wouldn't have been lost.
    It will no doubt be on sale again in a day or two.

    Yes, no doubt. And when the item reappears at a higher price, and after the seller has left a reply to your negative feedback, claiming it was unavailable...

    Then you can also leave follow-up feedback, stating "Beware dishonest seller, 'unavailable item' reappeared as item 123456789012" ;)

    Then you can also leave follow-up feedback, stating "Beware dishonest seller, 'unavailable item' reappeared as item 123456789012" ;)
    You can then watch ebay remove it as you are not allowed to refer to other listings in your feedback.

    No, please don't, please actually cancel, as then the seller will be stuck with the fees.

    Leave something like - Seller refused to sell, item apparently unavailable.

    It will stick, it doesn't appear potentially defamatory, it won't break any rules and it doesn't make you look like an argumentative, shouty muppet.

    I'm going to decline the sellers request to cancel the transaction.

    He has answered all my emails and also refunded on same day. I feel bad about negative feedback because I only wasted my time really but as you guys have said no doubt the item will be on sale again in a day or two.

    Should I leave neutral or negative feedback? At the end of the day he could be telling the truth, and actually lost the item. Who knows!!!???
