PILON/Tupe/Redundancy

My OH worked 99.9% on a contract (Company
for the last 3 years out of 9 years employment. This contract has just been sub contracted to an alternative company (Company C).
He thought that he was going to TUPED over to Company B but has been told today he is to be tuped to Company B and they are going to make him redundant pretty much staright away.
Should he have been tuped to Company C ?
What PILON of notice should he be getting ?
All very new to this ......

What do you mean by working 99.9%?
Is there a Company A?
"PILON" is Pay in Lieu of Notice - it is paid if notice is not given for the full amount due under the contract of emploment.
The amount of notice he is due will depend on how long his continuous employment is at the time notice is given and in accordance with his contract.0 -
So he's been employed by Company A continuously for nine years?0

If it is a straight contract moved from A->C then TUPE probably applies but it is a complicated area so details may make other options possible.
To answer the other part 9 years for any service related payments.0 -
Yes employed by Company A for 9 years (originally employed looking after another contract) . I think he should have been tuped to Company C (who is now doing the contract on behalf of Company
but that has never been on the table.
