Hi all, can i ask your advice as my son and his partner split up in .
December of 2010.Last week he was sent a demand by our council for £1392.55 overpayment of housing benefit.When we called in to ask why it came to light that my sons ex- partner had been receiving the money into her account all the time.They insist my son is liable for this even though they can see on their system that he never received a penny of it.Because the claim was registered in his name they claim he owes it. Can we do nothing to fight this.

Assuming he signed the original HB application form then he should have informed them when he left the property. Did he tell the Council Tax department that he had left the property? if he did then sometimes it's possible to argue that this notification should suffice as usually the 2 benefits (HB and Council Tax Benefit) are closely related.0
