Never mind about doing section 78 requests (with or without a signature). This almost certainly is not your debt.
It is their responsibility to prove that it is yours, and that it has been acknowledged by payment or in writing without a six year gap.
Send a prove-it for now.
Or possibly this one if you want to dispute both aspects. ---> letter

Think people are getting too anal, not all companys are the same

Thanks for all of you replies, wifey feeling much better today so all reasonably calm here again... well other than all the capquest calls which I am ignoring. Yes we had a serious forgery case with them before, again they claimed I had taken out a loan with them and produced a forged loan agreement to back up this claim. I was lucky enough to have a very good soliciter who came down like a ton of bricks. After a bit of a struggle I received an apology, loan closed (I never actually applied for one) and a member of staff was dismissed from our local HFC branch!!! No police investigation but well you tell me................ Running with the prove it letter. I dread to think what these companys can do to people who are in desperate situations. At least I know I have nothing to worry about so can look at this as a bloody nuisance but nothing more. Thanks again will keep you informed! :beer:0
