Hi all,
Need some advice with this lot of cowboys. I recently parked my vehicle at a large hotel in Glasgow to collect 2 clients who were staying there. I never noticed any machines or notices to tell me to pay. And I did look, It is possible I never looked hard enough I am not to sure. However within 3 wks I recieved a parking fine from the above for £120.00. If I paid within 14 days it would be £60.00. I have been following what people have been saying on this forum and just ignored the letter. I have now recieved another letter saying I have until this Friday to pay up or I will recieve a Judgement from the courts and should I fail to pay that then a sheriff officer and baliffs will turn up to remove goods from my house. I am slightly concerned as I work away from home most of the week and have 4 young children. The last thing I want is baliffs knocking my door down possibly harming my wife and children and removing goods.
There approach has been very aggresive and if they do turn up on my door I just hope I am at home!!
Need some good advice.

They have missed an awful lot out that would need to happen before bailiffs could turn up! Firstly they would have to take you to court, they would have to win, you would need to fail to pay, and they would need to go back to court to enforce.
Is this still Parking eye making these silly threats or one of their pet DCA's or solicitors. Whoever it is, is talking rubbish, plus parking eye are yet to see the inside of a court room, as a claimant anyway!0 -
I make a habit of ignoring begging letters from this shower and have never been taken to courtStill waiting for Parking Eye to send the court summons! Make my day!0

I've had all of the above nonsense too, from our mutual friends, Parking Eye. All of the PPC's are equally inept, but I think that Parking Eye are among the worst.
Parking companies aren't allowed to issue penalties to citizens, and as a matter of contract law, all they are permitted to request is money to remedy losses incurred. So, if parking was £1 per hour and you stayed an hour, you would technically have caused them a loss of £1. The reason they fail to follow through with their threats of legal action is because courts have found in favour of the motorist more times than not, as it is clear to anyone with even half a brain that their ridiculous demands for figures plucked randomly from the air are in fact nothing other than penalties, that bear no relation to any losses suffered.
So ignore them. Don't contact. Don't bother trying to "appeal", all you will get is a standard letter telling you your appeal is unsuccessful. Check out the Sticky about what to expect in the post, and relish the thought that they will waste money posting letters to you!
PS. I'm fairly new to this whole ignoring PPC's thing myself, but thanks to forum's such as this one, you'll become familiar and confident remarkably quickly about ignoring these ridiculous claims!!0 -
sorry, im new to this. I dont know how to post a new thread but anyway just need some advice. Prob not alot that can be done now but I entered a supermarket car park and ignored the pay & display signs. Did my shopping and left.
I received a parking fine letter from Parking eye stating i had to pay £50 which I did. Having read all these posts I now realise that I could have ignored it and possible got away scott free.
What I want to know for future reference, if I was to not pay again and they were to send me a fine if I ignored it like all the posts on here suggest, will I get away with it?0 -

Yes you will. Of course, on the one hand - it is a shame you paid £50 to those apes, on the other, many people do and I am glad you have found this forum and familiarised yourself with the facts.
The £50 you paid is unlikely to return, it is complicated to explain why. All you need to know is that these so-called "charges" are wholly illegal. ParkingEye manage car parks but it is the landowner that can sue and he in turn can only push for losses resulting from your actions. Now regarding ParkingEye, not only do they have this argument against them but they don't even know they have the right person when they target the keeper. It is enough for a keeper to claim he was not the driver but these PPCs continually press at that person until he divulges the name of the person driving. This is harassment and is in the eyes of the law, illegal and carries stiff penalties. This is why the best advice is - simply ignore. Debt collectors = nothing, they are not bailiffs and the money they seek has not been proven in court.
What I always say to people who have once paid an unfair charge, you can exact revenge by parking on the antagonist's car park any time you need for ever - you've bought your season ticket. £50 is more than it will cost them if you park 10hrs a day for the next 100 years. Your conscience is clean.

It was never a fine and there's nothing for you to get away with. IT'S A SCAM.
It's the private parking companies who get away with murder by passing off a piece of paper to look like a parking ticket. So sorry you didn't check online about PPCs before falling for the scam. Ignore any in future, unless a parking ticket comes from the Council or TFL or the Police then it's not real - even if the supermarket stupidly believe it is.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I bet it doesn't say that. It will say they may attempt to obtain a judgment against you which could affect your credit and bailiffs might turn up.
Put another way, if you don't pay, there is a 0.1% chance they'll take you to court, where they would have a 0.1% chance of winning anyway.0 -

You've learnt a costly lesson by paying them, but in the future, make sure you ignore them. And more importantly, tell as many friends and family as you can about the scam and direct them to forums such as this one.... we should all club together and get these con-artists out of "business"!!! And the only way to do this is not to play ball with their non-existent "appeals" system but to ignore them, ignore every letter and not pay a single penny and watch them go under!0 -

I'm going through the same thing right now. After reading this forum I've decided to ignore all the letters from Parking Eye from a recent overstay.
I'm on letter 3 - which is the one I think you also have. Look at it more carefully. They say if you don't pay they MAY take you to court which MAY result in their winning which MAY result in bailiffs etc. According to everyone here, they aren't even going to bother taking it to court. So nothing else will happen. I do understand your feeling nervous though, so am I, even though I understand that the letters are just a load of waffle.
Bailiffs can only act to enforce court orders - CCJs - companies can't just send them in by themselves. So if you haven't received an official court date, attended (or not), and lost, don't worry about bailiffs.Cash not ash from January 2nd 2011: £2565.:j
