Court case re; Insurance

I personally would go with the court case, because I'm a stubborn git.
I wouldn't expect to win though. A 50/50 resolution sounds more likely as its your word against his in effect. The damage could have been just as easily caused by you pulling into him as him pulling into you really. If you think of line of sight, if the damage is how you describe at the time of the accident you would have been a little infront of him. This means its more likely that he could have seen you from this position, than you could have seen him.
Not that I don't believe you, I'm just playing devils advocate to let you understand how anything can be questioned and turned around to somebody elses advantage.
I still say take em to court. They'll probably drop it at the last minute and offer settlement rather than waste their time on an expensive court case if they're doubting it, as it'll cost them way more than £1100.0 -
For everyone following this, there was a cheque in this mornings' post for my excess and a letter to say my NCB is still intact.0

Good news. Obviously the other insurers weren't confident they would win after all. Just goes to show it can worth standing your ground but what a shame it took so long to sort out.0
