Flyjet problem

I am still waiting for a response for a complaint levvied against Flyjet for an overnight delay back in September. I have received two letters from them - each time stating they will get back to me within 28 days (legal obligation I assume).
However the latest letter is nearing expiry - as such what are the legalities should they not reply - or if they do reply with another we'll get back to you in 28 days?

At which point do I take legal advice?

    Also if you google david harbord thomas cook you will see one of the few cases where people have succeeded.Thomas Cook employed a Barrister to argue that a cancelled flight actually was technically "delayed,"not cancelled,as they laid on another flight with the same number 24 hours later.

    It seems that the companies are effectively ignoring the regulations.
