Item not as described, seller has no returns listed

I had a search through but couldn't see a thread that would answer this so I apologise if it's been asked before.

I bought an item of clothing on Ebay last week and it was described as being "Like New" with Ebay's definition being Like New: An item that looks like it has just been taken out of its shrink wrap. No visible wear, and the item is flawless and intact. See the seller’s listing for full details and description of any imperfections.
The seller hasn't listed any problems with it and I bought it in good faith on that description, I'm not in the habit of buying and wearing worn clothing but thought that something "like new" would be okay.

It's arrived and it's most definitely well worn. It's a sweatshirt and the material is really bobbley, especially on the arms and around the rib at the bottom - if I'd been selling it I would have described it as being either Acceptable or Used.

Unfortunately on the listing the seller has said that they don't accept returns. I've messaged them but haven't heard back yet, and I'm just wondering if I have any comeback?

    If you paid by Paypal and you don't hear back from the seller then start a ' not as described' dispute with Paypal, not Ebay. It does not matter whether they say no returns, paypal will ask you to return the item and you should have no problem getting a refund

    Sellers terms mean nothing, as above if you don't hear from the seller, I'd message them again and if no response then open a SNAD in Paypal. You will unfortunately have to pay the returns postage but you will get a full refund of your initial payment, inc p&p the seller charged you.

    Just bringing this back up for more advice if anyone can help...

    I've finally received the refund from the seller, she has admitted that it was a mistake in the listing.
    I had this message from her a week or so ago -
    Would you mind posting the item back to me and I will happily give you a full refund?
    Otherwise I will refund the cost of the item minus the postage.


    Now reading that I understood it to mean that she'd give me a full refund if I returned the item but the use of the word 'otherwise' implies that if I kept the item then she'd just refund the purchase price.

    I returned the item immediately and she's issued a refund today but hasn't refunded the original postage I paid to her, just the purchase price of the item - she received £12.50 from me but has only refunded £9.50.

    She is supposed to refund your full initial payment, including the postage you paid to have it sent to you. However, if you haven't sent it back tracked, then you may have difficulty enforcing it.

    The best way is to approach it in a friendly manner.

    Thanks, yes it was tracked and is showing online as being delivered and signed for 10 days ago. I'll wait for her to get back to me then and see what she's going to do.

    Excellent.

    Give her the opportunity to refund. If she doesn't then you can use your tracking for a claim. (SNAD). You will have to open it, escalate it, wait the decision to return, then add the tracking.

    I would also be inclined to think seriously about the feedback I would be leaving.
