Beneficial Finance / HFC - Restons Advice needed Please

I'm using my partners login.

In Dec 2004 I took out a loan from Beneficial finance paid it for so long then got into difficulties regarding being ill, off work for a very long time and so on and the payments lapsed.

I paid them as and when i could sometimes not as much as I should each month, other times lots more than I should have to try and keep the payments the right amount. At around the same time my partner was seriously ill in hospital with a brain injury and was in for many many months, and the hospital didn't think he'd recover, so as you might imagine it was a very very stressful year. (Thankfully he did eventually recover)

Anyway in the end I got totally out of water and it and other bills got left unpaid.

In 2008 HFC sent me letters asking for money and eventually telling me I was in default. At this stage I had no idea who HFC were.

I asked them for details of the loan and eventually they replied with a couple of statements, and a copy of of 2 agreements from Beneficial Finance from the 14th December 2004

One states that i had a loan of £2675.00 Plus £1855.24 interest, Total Payable £4530.24

Then underneath it, it says PPI Life assurance £240.43, Accident sickness and unemployment £480.86 Total £721.29 PLUS Interest £500.31 TOTAL Payable £1221.60

Then on the 2nd agreement it states
Hamilton Insurance, Personal accident plan £249, Single Life cover £22.38 and ASU cover £44.76 Total cash price (amount of loan) £316.14 add Interest £219.06 Total repayable £535.20

This is really wierd to me, it seems they not only sold me unwanted (unknown about) PPI but they sold me an ASU policy AND THEN PPI also.

I came across these papers the other day because I had a letter from Restons Solicitors 2 weeks ago threatening me with court as I hadn't paid the whole loan off.

Now as they are still wanting me to finish paying the loan and as the last payment I actually made was on 7-7-2008

CAN I claim the PPI back?

If I can do this then it will work out that they will actually owe me money as what they would owe me is less than what I owe them.

Hopefully that makes sense.

    Hi there Karen, glad to hear your partner recovered.
    Put a claim in for mis sell, if you knew you had this ppi you could have claimed on this when you were off work.
    Look here for other reasons you may have been mis sold and include them,you will get all the info you need here to make a claim

    The thing I'm not certain about is the date I took the loan/PPI out was Dec 2004 which is over 6 yrs ago, but I was definitely paying it off in 2008

    And your right, IF I had known I had PPI or even the ASU insurance which was a seperate policy I didnt know I had then I definitely would have claimed.
