House buying advice please!

I am writing to hopefully get some advise quick regarding buying a house in scotland.

My friend has put an offer in to a house (fixed price) and some else put in the same offer with exactly the same conditions on theirs but half an hour earlier. The sellers solicitors has advised the seller that they HAVE to accept the first offer as this is what is stated in the "law agency". The seller was wanting to seel the house to my friend but feels like his solicitor, is forcing him to sell to this other couple.

So, in short, can a sellers solicitor forse the seller to accept the first offer???!

  • Tell your friend to up the offer by £100 or whatever as the seller can choose the highest offer regardless of what order it went in...

    Whatever the level or condition of the offers, I believe that the seller is completely free to accept whichever he pleases: It needs not be the earlier one, it needs not be the higher one.

    If the seller wants to sell to your friend, he should reach an agreement with him and execute it. Other offers are irrelevant, unless of course the seller is actually posturing to extract a higher offer from your friend...
