DSI Faulty

Hello guys,

I ordered a Red DSI £186.00 from the catalogue and when i came we switched it on and the screen was cracked. I returned it with a note explainung the items screen was cracked, hence me returning it. A few days later it was credited to my account. Around two weeks later I got a parcel, opened it, and it was the DSI with a note stating it had been returned to me as it was broke and the £185.00 had been added back to my account along with charges and postage. I wrote a letter going saying how disgusting it was to return it to me as i received the DSI in the way i returned it. I got a letter back stating that they would not have the DSI back as all items are checked before sending and it would have been fine when sent. They refused to refund any money or have it back.

What can i do or say to get the decision changed? Can they do such a thing? what rights do I have?

  • When you say that the refund was credited to your account, are you referring to a credit card or your bank account?

    If this is the case then you should contact the card issuer or your bank and tell them that an unauthorised transaction has been made as you did not make or give permission for the second sum of £186 to be made.

    How can they have checked it when the item will have been sealed.

    That's really shoddy.

    I presume you've had it less than 6 months, so the onus is on them to prove that the item wasn't faulty at sale. As flyboy pointed out, DSI boxes are sealed, and so it is highly unlikely that they would have unsealed every box to check the screens are fine.

    Send it back, quoting their responsibility to prove that the item was fine when sent. Also, as it's their responsibility to get it to you in one piece, if royal mail broke it in transit, that is still the catalogue's problem.

    They don't really have a leg to stand on.

    When they capitulate and give you your money back (don't let them credit it to your catalogue account), buy a DSI from somewhere that isn't a rip off. You can get a 3DS with Ocarina of time (the greatest game EVER made) for £149 from game - better hardware and compatible with all DSI and DSIware games.

    It was from my catalogue K and Co. The item was credited back to my account but then after sending it back they re-charged it back to account plus charges and delivery. It is expensive but I can only afford to shop via catalogue where you pay for things monthly as i do not have the cash upfront.

    The item was sent back the day after receiving it so i was only a day old.

    What can i do? They've sent me a letter saying the following;

    Unfortunately this item cannot be accepted back as a return due to the screen being cracked and as such you are liable for charges raised and any outstanding balance relating to this item.

    I regret I am unable to help you further with this matter.

    Send it back, with a letter stating the reason why you rejected the product in the first place. Tell them that, according the sales of goods act 1979, you have the right to reject the item as it is not of merchantable quality and not fit for purpose and that you expect a full refund, including the costs of all postage. It might also help to ask them how they could have checked the goods, if the packaging was sealed. If the packaging was unsealed they, will be in breach of contract with the manufacturer/wholesaler.

    You might want to let them know that you are forwarding all correspondence to Trading Standards and Consumer Direct; giving them seven days to comply, or you will be taking action through the small claims court.
