Absolutely, but you cant do anything without the lender agreeing. If you are an existing customer with decent payment history, then you have more chance, but if you have struggled on this card with the limit you have already, then perhaps not.
  • i always pay the mininum. I only have a 200 limit, so i suppose i can max it out every month and pay it off in full. would that help?? also wont they do a credit check??

    Edit:
Its one of those capital one card, that help build credit history. the worst thing is that its not my default. i think its identity theft.

It does depend on what they say, but I just meant it was technically possible, and I wouldnt think they would do another credit check as you have been accepted, and they can they see your repayment history.

The fact it is one with a very low limit, might change things though. How long have you had it? It might be worth asking if you can switch to a better card if you have had it for 6-12 months at least. You are saying it isnt your default, have you or anyone investigated the reason for it? You cannot be served a default if you can prove it wasnt you who did whatever it was. You should get some advice from citizens advice or one of the free debt management agencies. Otherwise, Im sure there are more knowledgable people on here who can tell you what to do regarding this. You cant just accept you have a default though if it was not you who caused it. Why did 'you' get it?

  • the worst thing is that its not my default. i think its identity theft.

    2 things really:

Firstly, what have you done about this suspected identity theft? Do you have copies of your credit history showing who this default is to and when? Do you recognise the company?

And secondly, how long have you had your card with Capital One?
The above facts belong to everybody; the opinions belong to me; the distinction is yours to draw...
  • Its from a natwest credit card i think, and ive got a O2 phone line and a debahams store card that ive never used. Ive had the capital one card since 2002, and never had a limit increase. Im not sure what to do about the identiy theft. how do i go about getting rid of them???

Im a university student studying in leicester, and i think they opened them at my old halls of residents, (which i left half way of uni) which also had a shared post box where all my statement and credit card bills went.

I got very threating letter from these companies to my home london address, and just decided to pay them off, thinking that they would just removing them from my file.

I dont mind if i dont get the money back, I just want them removed for the CRA's. what should i do?? Please help!!!!!

You did the wrong thing. Paying it and keeping quiet won't clear your credit history - it will just show a very late payment which you eventually settled.

The correct thing to do is to tell the credit card company it is identity fraud. If you had done that you would have got your money back and cleaned up your credit history. Since you didn't there is nothing to stop the fraudsters doing it to you again and again.

Once you have told the credit/store card company they will issue you with a new card with a different number.

    Take action now!
  • so what should i do, no-one of the are my accounts, has paying them made my look guilty???

Unfortunately, I would say yes. :(

However, that is the short answer. No way should you have to pay for something that you didnt buy!! From what you say though, you got the default in 2002? I would say you would be very lucky if you could get any sort of investigastion done at this late stage, and that is if you could convince a lender you are telling the truth. The lender is bound to wonder why you have suddenly told them about it, especially after paying off the debt. Im sorry this is probably not what you wanted to hear, but you should still see if anything can be done.

The default will stay on your file for 6 years since it was registered. They can be removed early if the lender agrees, but you will have a fight on your hands I think to convince them you are telling the truth.
