Electronics in warranty but faulty, can I get a refund?

Hi, I have a question and my research on the web hasn't made it completely clear in my head, so maybe you guys can help.

In April I bought a fancy freesat box on ebay, it was bought "buy it now" and with 12 months warranty.

3 months later it stopped turning on, I contacted the seller, I was told to contact the manufacture. I did this and got the broken unit replaced (3 week lead time with a day taken off work as the delivery was 9-5 mon-fri).

2 weeks later the same problem has returned.

Now although the warranty people are pretty resonable, I don't want to wait the 3 week lead time and take a day off work, I also think there may be something fundamentally wrong with my set top box, I feel it's not fit for purpose and would prefer a refund to buy a different one.

Before I contact the seller again, can anyone give me some advice?

I have read some contradictory things on the internet, but is it within my right to ask for a refund? I have read if I do this within 6 months I have more rights?

  • Generally you can require the seller to repair or replace a product that goes wrong but there isn't any statutory right to a refund. You can ask (we all have the right to ask whatever we like!) but they can say no. If the product has an inherent fault (ie there is a problem with the design that causes it to go wrong) then you can ask for a refund but this is often hard to prove unless you can find a lot of other people who have had the same problem with the product.

    The six month rule is that if a product goes wrong within six months it is up to the seller to prove that the fault didn't exist at the time of sale. If it goes wrong after that time you still have rights to a repair or replacement if it is due to a fault that was present at the time of sale but the onus is on the consumer to prove the fault existed.
    Common sense?...There's nothing common about sense!
