no succsess with claim management company

I have been informed by the claims management company with whom I was taking up my claim that my claim has been unsuccessful. I am bitterly disappointed by this as I know I was missold the policy. I want to appeal with the FSO. Am I under obligation to continue the process with the Claims Management company or can I appeal directly. I am not particularly happy with the service received to date from the Claim company. They were very good initially with obtaining my details but there has been very little followup and communication since (it has taken ten months so far). They are asking me to complete a form so they can contact the FSO on my behalf so presumably I have not already given the authority for this next step. Can any one help please?

    Hi and welcome

    I would get in touch with the claims company first to make sure, in case they will be doing this, did they actually state that they will move it on to the FOS?

    If all is ended with these, then there is no harm in doing this yourself, good luck.

    I would state that whilst none of us here are fans of CMC's, the wait is not really their fault (which lender are you claiming from?)

    There are many people that have endured 18 month - 2 year waits and there is little anyone can do when a bank is failing to act with decent haste (all the calls/letters in the word do not seem to make them speed up)

    The 10 months you state would include the period a lot of claims were on hold due to the Judicial Review, so (again) dependant on the bank, 10 months to get to a decision from FOS would seem like a good timeline - many have endured much longer (myself included!)

    I attempted to fly solo after being completely treated like the poor relation with the Claims firm whom I unfortunately went to with my claim and they were still going to charge me the 30% for doing bagger all after I told them I was fed up with them as was going to do it myself. A few phone calls, a few forms sent off and thats all they have done. I then went as I was so enraged by their total lack of proactiveness (for want of a better word) and emailed Lloyds myself, rang, wrote, raged and ranted and that didnt get me anywhere either. However, I have been informed that Lloyds now are going to offer me a refund - after 4 years!! I just hope that there is something there after the Claims company have taken their cut. When it will happen is anybodies guess frankly....

    But good luck and dont lose heart - do anything in your power to get your money back......dont forget you are dealing with corporate theft....

  • Thank you for your support and encouragement. My biggest frustration with the CMC is the lack of communication from them. All the chasing in the process so far has been done by me and every time that I have contacted them I am made to feel like some sort of nuisance caller. I am not convinced that they are making the best presentation of my particular case. If you have any tips for how you managed to push your arguments with the lender I would appreciate any help you may give.
    My point is I I did pay for PPI - I was not given any choice in the matter - it was mis-sold to me. By the way my lender was Black Horse (I believe one of the biggest lenders for these cases).

    Have you tried speaking to Lloyds? I've found them really helpful, and that's more than one person. They are not obstructive in my experience. Please do not get in deeper with the CMC, they mislead & misinform when they do contact you & you will be far better off doing it yourself. The banks have just 'chosen' to pay after all.

    Did you pay money upfront? Did they tell you they'd get the balance of the loan written off? Because I've been told that's a scam, they can't & haven't been able to since 2009/early 2010 when there were test cases. (Thanks dunstonh)
    Ring the bank, speak to them, that's my suggestion. Good luck.:)

    Hi thank you for your advice.

    I have contacted LLoyds Back Horse directly and they are going to send me their response. They have informed me that since my agreement was taken out before the FOS arrangement was in place I do not have recourse to appeal to the FOS. Apparently I need to appeal to the FLA since my agreement is not covered by the FOS (it was taken out in 2003). Is there any truth in this?

    The sums of money are substantial loan was for around £16000 and tghe PPI was around £4000. The loan has been settled in full already. Please help if you can. Getting that sum of money returned would really help.
