Tesco Direct Gave Incorrect Information

Hi All, :)

I would welcome any advice on the following problem...I emailed Tesco Direct about a month ago to ask if the Silentnight 4 drawer beds they sold were full size drawers or could the continental version be bought. I received a telephone call from them confirming that if I purchased a 4 drawer bed from their website, I would receive a phone call within a couple of days to ask which version I would like the full drawer or continental version. Based on this information I purchased the bed.


When Silentnight contacted me to arrange delivery I mentioned that I had not received this phone call asking for my preference and was told that the Tesco 4 drawer beds only came in the full drawer version :mad:

During many emails swapped with Tesco's CEO office they have told me that it is not there fault that I received incorrect information, as the advisor I spoke to had been given the information regarding the continental drawers by Silentnight, so due to this they can only offer me a refund and a small gesture of goodwill.

This means that to purchase the bed now from elsewhere will possibly cost me a further £100, as the bed from Tesco Direct was on sale.

Is there anywhere I can go from here, or do I just have to accept the gesture of goodwill and purchase a 4 drawer continental bed from elsewhere at extra cost???

Any help or advice will be gratefully received,

    Buy offering a small gesture of goodwill, they have already done more than they need to. Take it :)

    Yes I can, I have details of who I spoke to and the CEO office has also admitted they gave incorrect info to me which led to my purchase.

    So someone made a mistake,
    If they are offering you a refund and a gesture of goodwill I would take it and run.
    Shop around, you will no doubt somewhere find a bed that is around about the same price in a sale elsewhere.


    I cant think for a moment what else you expect them to do.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    I would like the bed I was promised which led me to spend a few hundred pounds. Silentnight make the bed I want, so if Silentnight gave Tesco duff information. Tesco should be asking them to put it right for their customer and not just washing their hands of it,while I have to spend time sourcing another bed for similar money or spending extra money I shouldn't have to spend!

    Does anyone know if it could be classed as misrepresentation?

    Your getting a refund plus a good gesture of good will so take it and run.

    Thanks for your replies. I appreciate that people make mistakes, but if misleading information leads to a purchase then surely the item has been misrepresented, and if a company can rectify the mistake, then surely they should do more to do rather than just pass the buck onto another company and ask their customer to either accept an item they clearly did not want to purchase, or pay extra to buy it from another company.

    Yes they misrepresented and you are entitled to a refund if they are unable to provide the bed you wanted. SOGA, not as described.
    But no, they do not have to source you the bed for the price you wanted. The fact they are offering a goodwill gesture is excellent customer service for a mistake.

    If I have a claim for misrepresentation, then surely the goodwill gesture they are offering should allow me to purchase the bed I believed I was purchasing?
