Hi all,
Urgent please help...
Just thought id ask the question to you all before ringing ACAS.
Don't see the point of going to CAB as all they seem to do is read from the internet which is what i can do at home. They also only deal with straight forward cases...of which this one isn't
Sorry for the long essay...
Basically been working for a company for under 2 years now. The company had 2 branches and have since amalgamated 2 into 1. I was only in work a couple of months before i had to have an emergency operation on my knee cap (basically went out for my birthday and ended up falling and smashing it on the floor). Ok so it was my own fault but previous to this i had had no time off sick or went in late and rarely drunk to be honest.
I had my operation in Feb 2010 and was off for 4 weeks (supposedly 6 but went back early in the goodness of my heart to help work out).
I then found out i was pregnant and went through maternity leave etc all fine. My daughter was born in December 2010 (of which was the same time the 2 branches merged into 1) and was due to go back to work in May after 6 months. I didn't. I wrote to them (in good time) to request to be off an extra 3 months which was accepted. Work left it till about 2 weeks before i was due to go back and to have a meeting with them to discuss my hours etc.. I explained that i had sent a letter in ages ago requesting flexi time for 25 hours a week and they said they didn't receive it. I didn't include and specific hours due to not knowing whether the amalgamated branch had the same 'busy times' as before and thought me working around them would give me more chance of it being accepted. It was refused basically on the grounds of restructuring and that 'possible redundancies' would be taking place.
So now that leaves me to my problems... I had already been to the docs about suffering with Post Natal Depression since my daughter was 3 months old. I was given a sick note for 4 weeks so i didn't have to go back at the end of july but I didn't hand it in because i thought id bite the bullet and go back thinking that it may acctually help me and because that is what i had told them id do and i didn't want to mess them around. Anyway, I was given the option to do part time for 4 weeks in order to arrange child care for my baby.
I started back doing mornings and used occurred holiday for the time i wasn't there. This was all fine. I was back 2 days before receiving letters/having meetings for the start of 'possible redundancies' and that only myself and one other would be up for it (i stand no chance against the other). It was down to cost saving (which is understandable in the current climate!)...and now for the next added problem....
I'm due to have another operation on my knee at the end of August which means ill have to be off for another 6 weeks.... Trouble is i've now been told that the redundancies will be finalised and we'll find out who it is the week before my op.
What do i do for the best....
1) Stick it out and do my time, get made redundant, have no sick pay and no redundancy pay either
2) Go back to the docs and ask for a sick note to cover me from now until after my sick leave...so i get 'some' money at least and for a longer time than 2 weeks!
3) something else?! suggestions please.. obviously legal ones and what would be the best option for me.
Im not even sure if the above is possible but i obviously have my daughter, house and bills to pay like everyone else. I just think that ive done all i can and now its time to put us first?!
What do you think? Any comments are welcome and once again...i'm sorry for the essay x

Do you know how much notice you will be entitled to if and when you are made redundant? That is, what will be the date your employment will actually terminate?
Because all the history is irrelevant - if you are going to be made redundant you obviously can't work beyond that point, but you could be dismissed for your sick record before it - that is the risk you take with option 2.0 -
I don't understand your second option as you can still be made redundant whilst you are on sick leave?0

Yes I agree. There seems to be no real dilemma here as sick leave does not delay your redundancy. If you are chosen for redundancy you will be made redundant whether present in the workplace or not.0
