Could she not look after herself and say "no"? Or were you jealous?

of course i was jealous. the bloke was a guy who i talked to a lot at work, i wouldnt go so far as to call him a mate, but for him to blatantly be trying it on with her broke all the unspoken rules as far as i was concerned. and no she wasnt exactly being a shrinking violet either.

no doubt she was egged on by the fact that it was all in full view of me as well.

and perhaps this is the most pertinent question you have asked.

if not sacked, then why not?

and of course that ex, because she is my ex would not stand up for me in the circumstances at the investigation.

as a matter of fact i held back from not punching the guys lights out.

those in charge knew the 'circumstances' and gave me a warning

Trying it on with an EX ???????? and she wouldnt stand up for you at the investigation ...............Maybe because it was non of your business who tried it on with her ( or vice versa)

You aren't painting a very good character reference for yourself

I think most people would say it is an unnatural reaction

Would you like a new shovel?

maybe it wasnt my business, you're right, but at that moment i reacted in what might be termed a 'human' manner.

for about 30 seconds i felt i was being slapped in the face repeatedly and i acted in a stupid manner.

you cannot deny there was some provocation, my poor choice to get involved.

as i said, she, in particular, made sure i saw what was going on.

And afterwards you carried out what I guess was a vendetta by emailing others about them .

And you wonder why you lost your job offer?

funnily enough it was her i e-mailed and asked her what the hell was said in the investigation, that i still liked her despite it all and that whoever set up the investigation (naming names!) was a !!!!!!! and weak. and yes she stitched me up on receipt of said email.

strangely i sent it to her personal email and not work...should that make a difference?

im reminded of a steely dan song, 'my old school', one line says 'i never thought the girl could be so cruel':)

as to why i lost my job offer, thats a different story.

i think a lot of it will have been with how it came about

the fact a clean reference was sent out

the tip off from the ex employee

    my confused denials under pressure

it all made it seem like there was something dreadful to hide.

I read your initial post and though I'd give some advice, I felt here's someone who's been treated badly by his ex employer, then I kept reading your replies.

Reading between the lines and your responses, I'd guess, given free reign there's a lot your ex employer would like to say about you, but can't and although you may not see it or admit to it, I'm guessing to them, you were a real thorn in their side and a bit of a nightmare employee.

I know people still have to earn a living, but take it from someone who was taken to tribunal by someone who'd lied on their CV, had 10 jobs in 5 years, taken the previous 3 employers to tribunal and been paid out to avoid the cost and negative publicity, then had to pay them £27k when they won against me, then had them call me and thank me for buying them a car.

    My sympathy is diminished

well i havent had three tribunals, in fact ive had none.

and id worked in the same place for 9 years, which means something, i think.

and can i ask you for what reason you fired this employee? quite frankly if they won, then it says as much about you as them as everyone knows tribunals are hard to win for the employee.

i have to say the phone call to thank you for the car is a maverick play that im not sure even i would be capable of:)
