Found out I am on deeds of property - What now, help!!!

  • The Leasehold Advisory Service may help...they have free legal advice although its mainly for the leasehold aspect. they did help me with a freehold issue though and were brilliant...they are government run and seem to deal with most property type of questions. http://www.lease-advice.org.uk/

    If the people living in the house are tenants (perhaps your OH hasn't declared them officially?) then their lease will have to contain the name and address of the landlord on it as you have to be able to contact your landlord if you need to serve them with notices...

    Is your OH also still on the deeds?

    you can find this out at the land registry too - it costs £4 to download the legal title...the land registry are also very helpful with advice in England - not so sure about NI though

    i think Woman's Aid is a great idea as the other poster said...

    Jungle Jane beat me to it, I was about to say that this is great opportunity to find your husband and finally start divorce proceedings, a consequence of which will be that the house and finances are resolved for good.

    Even if your ex isn't renting out the house 'above board' then the tenants will be paying their rent to somebody, follow the money!

    You will need a solicitor though, do you have any family who can help? I second the Women's Aid suggestion.

    Tell Santander that he is renting it out!

    It will cause trouble, but it might also bring him out of hiding.

    No I didnt sign anything legal Bettie, I bought the house along with husband I fled with dd as explained - bank have confirmed as have the csa (they were looking at his assets) that my name is on the deeds

    If he is paying the mortgage I guess he can easily be traced. It may all take ages and ages but hopefully at he end you will come out with something. As others have said, legal advice would be good. Good luck with it. :)

    Thank you, went through a difficult time yes with abuse. I was actually horrified when the csa got into contact with me (i did receive maintenance but this stopped years ago) I have built a life of sorts it is a struggle for me with dd financially but always preferable than seeing him again even though it is 10 years ago.

    When the csa called me on friday, i did go into shock - I genuinely especially about the house and more so as I can barely afford rent each month and never see dd as I work so hard to pay for it so you can imagine how I am feeling now. I desperatley would love to see the house being sold as it would mean a deposit and a chance for dd and i to have a perm home, but on the other hand it may bring him back into our lives especially dd's although when he was given access (supervised) over 10 years ago, off he went and we never saw him again.

    Have used womens aid before but I just wanted all that behind me, but the thought of him renting out that house and dd and i cant afford to live in our rental makes my blood boil!!!!!!!

    Anyway will be seeking advice asap

    Very tricky/delicate situation here. Presumably he is using the rent to pay the mortgage, even though he should not be renting the property. If rent stops is there a danger of mortgage not being paid?

    You need to tread carefully to protect your asset ie half the house.

    Got a solicitors appt for Thursday, took a lot out of me even doing that after all he put us through!!! Anyway it is a free initial consultation which is good.
