TJ Huges Refusing refund on bed

I purchased a bed from TJ Huges in July 2010 for £230. I paid for it by debit card from their website. It seemed a little flimsy when I put it together but thought I'd see how it went.
By April 2011 it was totally knackered so contacted TJ huges to complain. They told me I had to contact the manufacturers myself (a little odd I thought, but did so any way) The Manufacturer, Sleep Design, told me I had to package the bed up and send it back to them by courier. I informed them that in me doing so that meant I would have nothing to sleep on. They told me that I could keep the mattress to sleep on as they could not take it back for hygiene reasons. Reluctantly, having no other option, I agreed and they told me they would give me an answer by the end of the week.
After 2 weeks and several rude telephone calls on their half, they finally agreed to issue me a refund but said I had to call TJ Huges to inform them that had agreed the item faulty.
TJ's agreed to the refund also but Sleep design was only allowing a return of £140, a £90 deduction for the mattress I still had!!! I disagreed as they told me they did not want the mattress back and what use is a mattress without a bed (plus it was a very low quality one). I told them they could have the mattress back and I wanted my full £230.
To cut a long story short, TJ's fobbed me off saying they would return my calls for another 2 weeks until....... they went into administration!!!!!!
Now they are claiming there is nothing they can do and refuse to do anything to help me. They won't even give me store credit.
As it stands I have no bed (still sleeping on a mattress on the floor) and no £230 to buy another one. I have kept all the paperwork and email correspondence for the bed and also have the TNT receipt for when it was collected.
Where do I stand as I'm just getting fobbed of and have even been told by TJ's staff there is a chance I may not even get anything at all.
Sleep design have told me they have issued TJ's with a refund so therefore that refund should get passed on to me.
Please help. :(

    As far as I'm aware they can deduct a portion of the refund for the amount of use you have had.

    Now TJ Hughes is in administraion you will have to contact the adminstrators however I'm not sure there is much that they can do straight away and you may just end up a number on the owed list and get back a very small bit of what you are owed.

    AS you paid by card have you contacted your card company however they do have time limits on claims but that depends on the card company. Hope this helps...

    I think your best bet is to contact the card company to see what they say, then try contcting sleep design to see if they can send you a replacement bed if you sent the faulty one directly to them and if that fails contact the adminstrators.

    Not sure that's going to work with a Debit card.

    You have more rights with a Visa debit card. Think it works out much the same as rights with a credit card.

    this is where pushing beyond rights can come back to hurt you - as above, a deduction for use is allowable, considering you had it a decent amount of time and yiou get to keep the mattress the £90 reduction would be consided fair IMO.

    As per above though, if your debit card wont help you might as well write it off and move on...

    I suspect that AlterEgo is referring to 'chargebacks' - see the section at the end of this article from the main site...

    Basically, Visa voluntarily offer the same protection on their debit cards as they are obliged to legally under Section 75 of the consumer credit act for their credit cards. However, I think in this case the time limit for initiating a chargeback may have lapsed....
  • As it stands now though I do not have the bed or the money. They took the bed away from me so I don't even have the faulty item. In my eyes that is theaft. If they do not want to issue a refund then they should give me the product back surely.

    It is not theft, you voluntarily sent it to them. And its not a case of not wanting to refund you, but not being able to afford you. I think you have to write to the administrators and treated like a creditor. But I would be surprised if you got much back at all tbh, as there will be soooo many creditors owed thousands, maybe hundreds of thousands you will be at the bottom fo the list.
