    Astonsmummy - Yes I have heard the same thing and I came on here a few months ago as I was worried about it, however the general feeling on here was that it is an unwise thing to do but she wasn't breaking the terms and conditions of her finance agreement.

    I have tried to pusuade her to go fully comp but she hasn't. Hopefully this may change her mind!

    Are you sure? The car belongs to the finance house and I would have thought that they would insist on fully comp. My t&c's of my lease state i must have fully comp and an excess of less than £500 otherwise i am in breach of it.

    I'd just get your friend to double check her agreement :)

    If your car is on finance its normal for the finance company to insist on fully cpmprehensive insurance as part of the terms.

  • I know someone (17 at the time) who bought a car on finance using daddy's insurance (fully comp). Without the lad's knowledge daddy saved some money by changing to 3rd party f&f.

    After driving through someone's fence and demolishing part of the house he ended up with £8,000 debt and no car.

    The OP's sister should be fine. Get round to the 3rd party and ask them to sign a short statement admitting liability. It's amazing how the story can change when advice is taken from family and friends.

    A signed statement isnt worth the paper it is written on... they can easily turn round and say it was forced on them and made to be done under duress.

    Secondly it is not either parties job to say who's fault it was but simply to agree the circumstances of the accident. They can again turn round and even if they dont say that they were forced into signing say that they dont know the laws of liability (the more classic example is someone going forward, someone reversing - so both cars going towards each other - car going forward believes it is their fault as they have gone into the rear of another car and could sign a statement to that effect. Reality is that as the other party was reversing they ahve the greater duty of care and would most likely be fully to blame or at the least the majority to blame)
