item received not the one pictured

My 10 year old son has just purchased a scooter from Argos, when he got it home he was immediately out playing on it so we didn't really get to see it. It has now developed a fault and on closer inspection, we have realised it is actually not the the scooter that is pictured on the website in the item description. The scooter picture is more than twice the price, a stunt scooter as opposed to the sport scooter he received and isn't even available to buy in Argos! What are our rights in this situation?

    take it back because its faulty.

    The packaging will have the Argos code on it so they will know its from them (although even this isn't essential as you presumably have the receipt).

    Images on Argos are representative - they arent always the items you get, they reserve the right to substitute the item with one of similar ot better specification at point of sale.

    In any case - take it back, they'll swap it out.

    the item received was not better than the one pictured though, it is worth less and is a more basic model than the one in the picture.......

    Argos have their own 28 days no quibble policy anyway. Coupled with your statutory rights they probably won't even batter an eye lid when you return it.

    I said, similar or better.

    They deemed the item offered to be similar or better.

    In any case, its faulty, take it back and explain. Politely.

    ^^ and make sure the replacement you receive matches the item you are expecting to receive, not the incorrect one you are returning.

    That won't happen as the OP stated that the scooter pictured isn't available at Argos.
    All that has happened is that the wrong picture has been used in the catalogue

    Return it for a refund, then go to a shop that sells the one that is twice the price if that is the one you wanted.
