Cheque Centre taking money without consent

Hi all, new to the forum and im looking for a bit of advice for a friend, wasnt sure where to post this either.

She had a payday loan with cheque centre and lost her debit card, got a new one and was paying paying back the loan on a month by month basis as agreed by them, last month they took her new debit card details.

She has checked her bank this morning and £700 has been taken by the cheque centre without her authorisation. She is going to call them at 9 but the bank said there is nothing they can do, and is now left with no money for the month.

How would she be able to get the money back, if at all? surely the company cant do this without her authorisation?

Any help would be greatly appreciated.

    check the terms, length of agreement etc etc

    Without those facts we can't help you much to be honest.

    Payday loan companies get very jumpy around late/missed payments as most of their customers are massive credit risks who are refused bank loans or mobile phone contracts even. If she lost her card, and asked for a replacement, the lender may have been unable to collect one payment on time, so according to their terms, they went into panic/default/getbackwhatwecanwhenwecan mode, which would have cleared her out. They are VERY jumpy, so this may be the case/cause and is almost certainly in the contract/deal terms somewhere.

    yeah she thinks thats why, however a soon as she got her new card she provided them with the details in order to carry on with her payments, then this happens. she's in a right state over it all. hopefully get something sorted when she calls anyway. what she is saying though is that she didnt receive any terms/conditions through the post when she set up this payment plan, no confirmation either.

    It wont matter as said its in there terms missed payment = loan company attempting to collect all monies due

    I presume she signed a loan agreement in the shop? That probably had the terms, or a sign on the wall, saying any missed payment would render the whole debt due immediately. This, and the fees they charge people who can't repay in full on the spot, are where they make their money, so don't get your hopes too high to be honest.

    A "Payday" loan is usually fully repayable after a month, and is extendable on a month to month basis at the discretion of the loan [STRIKE]shark[/STRIKE] company.
