    Is the house in a place where you could sensibly move in? If so, you can seek a restraining order if necessary to keep your ex out.

    Who has been paying the mortgage?

    Speak to the Council about Council Tax, you need to ensure they know when you moved out all that time ago.

    I would be inclined to download the detials of the property from the Land Registry (costs £4 and you need it anyway if you are going to see a solicitor).

    Thank you, no council tax as N.Ireland and Santander say he is paying and no tenant in the property.

    The fact that Santander says there's no tenant doesn't necessarily mean there's no tenant. People are supposed to get consent to let from their lender, but they don't always do that!
