:j Thanks so much, you have all given me good, helpful guidance. I know that I would be better off financially if I left my husband but it would destroy the kids if the family split up. The only bills that we are in debt with are CT & rent which are in both our names, I am paying the rent off at £100 per week and I have asked my husband to sort the council tax out, all other bills I pay but will have nothing to do with his debts such as business rates etc he still owes and I have told him that if one more bailiff comes to the door then I will take the kids & leave regardless.
The bailiffs have written down the kettle, toaster, cooker, hoover, x2 laptops, X box, ps3 my wii+games, dining table + chairs, my 2 settee's, dvd player, printer, deep fat fryer & sandwich maker!

    Hi C.cox

It sounds like you are trying to sort things out BUT personally, I think you need to address the following, for yourself and your children's sakes..

    1. Get professional advice NOW to differentiate between a) your own personal debts b) your husband's personal debts c) personal debts owed by both of you and d) your husband's business debts.

Did your husband trade as a Sole Trader or did he have a limited company? If it was a limited company then the company debts belong to the company and NOT you!

    2. Take responsibility for sorting out ALL of the finances as I get the impression as your husband does want to or simply cannot manage finances in an adult manner.

    3. Speak to your Local Authority regarding Council Tax and Rent arrears today / Monday, letting them know that you are seeking professional debt advice to resolve these matters.

    Good Luck

  • Other people have already given some excellent advice, get all your paperwork together work out exactly how much you owe and who to. Make sure you get a full comprehensive list from your husband as well. Reading between the lines it doesn't sound like he's been completely open about his finances (possibly because he doesn't keep a close enough eye on them) and you need to work out exactly what the situation is. Sit down together and work out your ingoing and outgoings and a full list of your debts then ring one of the free debt advice agencies for help.

Don't panic, I know it seems awful and totally unmanageable right now, but you can get help in working out how to pay these debts. The important thing is to face them and get started on sorting them out as quickly as possible.

not meaning to be rude, but you have an xbox,ps3 and wii plus 2 laptops but cannot afford council tax? seems strange all those consoles are a bit excessive, maybe you should sell at least 1, that would be at least £100 towards the baliff bills.

To me it seems that you are contradicting yourself, as you say i couldnt leave my husband as it would the kids apart, but then go on to say, i have told my husband if one more baliff comes i will leave him, empty threat perhaps?

There seems to be stuff you can do, like sell a few goods, your kids and yourself surely do not need all 3 consoles, especially as you are in debt, have you thought about upping your income? i don't mean gettiong another job, as you say that you are a nurse, which is great, just maybe ebaying/amazon, check out the up your income thread there are loads of ideas, i myself do mystery shopping and while it is not going to make me rich, i have earnt £50 this week, surely that kind of money could help towards something.

I am by no means trying to be mean here, good luck in getting past your debt, where there is a will there is a way! you can do it, be strong.

Why is your name on the council tax? Students (including student nurses) are exempt from council tax so the bill should have the single adult discount and be in your husband's name. If this is not the case you should get it changed, and backdated.
But a banker, engaged at enormous expense,
Had the whole of their cash in his care.

Since the bailiff has levied on these items, they "belong" to him/her and it would be a really really bad idea to sell any of them.

One way of really getting into trouble.

Hi, I am looking for advice please, I am married but I pay all the bills even though Im a student nurse and he's self employed, his money stays with him which annoys me loads. Anyway, I have been paying bailiffs off for council tax from last year, the bailiffs came and listed everything in my house even the toaster! Now Iv got a bill come through for this years council tax and iv been summoned to court on the 25th because iv not paid it but im behind in all my bills even rent because iv got to pay off last years council tax and now iv got bailiffs knocking on the door for bills my husband owes from when he had a unit for his business, Im too scared to answer the door now! honestly i feel like giving up. My husband went to the CAB to seek advice on going bankrupt but they told him because he's not paid any national insurance or tax they cant help him. Im at my wits end :(
I also have three children who live with us and am scared we will lose our council house

If your husbands taking a wage, why isnt he paying national insurance or tax?
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

If you have a council house that is an asset you simply cannot afford to lose because of the scarcity of them, really. Do you or husband have an expensive mobile phone that could be sold, iphone perhaps? Or any old phones that could be sent to mazuma etc? Do you have more than one tv set? Could you sell the more valuable one if so, even if that means watching a little one for a while?

There are websites too that you can sell used games/cds/etc on. Even at £2 each if you have 5 that is £10 less debt, which is a great start.

Bah, ignore me too in that case. I've edited my post to make life easier sifting through my poor reading!

The rest still applies if no levies on tvs/cds/etc. Does the op own a car?
  • O.k I understand about the baliff thing, but wouldnt it be better to sell them and pay of sed bill, rather than perhaps default and astill have taken? Just asking?
