water flooding from house and cannot find tenant

    so a jammed ballcock or cistern will never flood indoors it will always go out through the overflow pipe no matter what.

    It's coming out of the overflow pipe ok at the moment.

    Someone on our street had theirs leaking for about a week before they could be bothered fixing it. And they were in!

    Ring tenant if you have their mobile or put a note through the door.


    You can see it clearly from the front of the house then?

    You could try the neighbours and ask if they've seen them recently - they may have mobile number.
  • Sounds like the overflow is doing it's job. You can't just go smashing your way into their house because you are paranoid and then expect them to pay the bill. Ridiculous.

    Why are you even skulking around outside anyway?

    If the flow is fast I would be a little worried that the overflow might be blocked or unable to keep up and the tank/cistern might be overflowing inside. I guess it's one of those things that should be checked or tested at least once just for peace of mind!

    No. If T is within their rights to change the locks then LL is liable for the cost of damage should he break the lock/door.

    LL having a right of access for emergencies only means that he is protected from committing illegal trespass not that he can blast his way in.

    Is that a statement or a question?

    If a question, no, one can never say never.

    Suppose a large piece of rust, or a dead bird/mouse, blocks the overflow pipe? What will happen? The overflow will stop working, the tank/cistern will fill to overflowing, and water will flood indoors.

    Howeverwhilst the overflow is doing its job, all is as well as statistics allow (NOTHING in life is EVER 100% certain!)

    It can also happens that the overflow pipe itself has a leak or joint problem. Since the overflow pipe is almost never used, it can happen that no-one bothered tested it until it's too late.
    I'm talking from experience here...

    How do you know the tenant changed the locks?

    As others have said, the overflow pipe is doing it's job.

    My neighbours have left their broken guttering and broken downpipe for 2 years to my knowledge and they don't seem bothered about it as it hasn't damaged their house yet.
    RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

    I know this is hard for a lot of landlords to accept, but under the terms of the AST the house effectively belongs to the tenant while they are legally residing there. They dont have a lot of rights otherwise, and yes you can sue them through the a$s for repairs, but no you cant just force your way in because you think they have left a tap running.

    If you want to walk in and out of your house at will when you are worried about it then there is a very simple facility to do that, just dont let it out.
