deposit question

My boyfriend viewed a apartment today and he signed the contract and left £50 deposit in a view to meeting tomorrow to pay the remainder of the rent and deposit.

He recieved a reciept via email saying
DEPOSIT CONFIRMATION
£50 received from xxxxx on 11th August 2011 as part payment of the £600 deposit required to secure lease for :
xxxxxxx, Belfast, BTxxxxxx

When he got back to work he noticed that the property was now being advertised by an estate agency at a lower rent than he agreed with the private owner. He asked her what was going on as the property wasnt advertised prior to this on this particular site we had located the apartment on gumtree. She replied saying she didnt know why the asking price for the rent was different to what she asked for and didnt give an explaination as to why it was now being advertised online when the contract had been signed.


In the mean time he got offered another apartment in the same area with less rent so he decided to take it. He emailed to let her know but she is now not refunding the £50 deposit saying she had cancelled other viewings and that this was compensation. I have been reading online about holding deposits and that he should have been informed it was non re fundable which it was not. Is he any way entitled to the money back or should we just forget about the money?

  • yes he did sign a contract the owner was then going to check references....

    If he's signed a contract and it states the rental amount I'm not sure he has a leg to stand up tbh.

    He wanted the property.
    He pt down as a gesture of good faith a deposit to hold it.
    He signed a contract.
    The LL cancelled viewings, believing a tenant had been secured.

    ....and he changed his mind!

    errr..... if he just looses his £50 he's getting off lightly. Could be held to the entire contract!

    That's what is going through my mind. If he has signed the contract then he's signed a legally binding contract to which he's agreed to pay £x per month every month for the next 6 to 12 months. If he gets away with £50 he's done very well indeed.
