Nuisance neighbour has more rights than us, even when he's in prison.

Oh right i see what you mean Elvis, i wasnt sure if it was definetly him or his family i was going on the assumption it could be anyone else outwith the nuisance neighours circle then DNA if never been taken would poss not be caught!0

I have missed the part where you know it was him or his family i just assumed you were unaware of who was to blame for the break in, sorry misread it then yes def DNA match should be charged with the crime!0

Thanks, that's a good idea. I have to be careful that my OH doesn't think I'm "nagging" (he has a busy, stressful job and sometimes needs a little encouragement to deal with stuff like this!), but I have said to him that he needs to adopt a harder line with the Housing Association.
If they can't make their tenant fix his window and fix his garden fence, then that's their problem for being so ineffective. They should arrange the repairs anyway, and I believe that they are obliged to in respect of their other tenants.
I fail to see why OH (and his neighbours) should pay a monthly service charge to live beneath a flat with an unsightly broken window and adjacent to a garden that looks like a rubbish tip, ruining any chance he might have of selling his flat.

If you live there too then you have a right to speak to councillors about it etc.0 -

No problem.:) We don't 100% know that it's one of his family (we're told he's in prison, so it can't be him). But all the evidence points towards this being the case.- His family are all scumbags. His mum is forever turning up at 2am drunk, standing at his front door (next to our bedroom), screaming at him to let her in. So they're definitely the type.
- The day that we arrived home at 6pm to discover the break in just so happened to be the day that the first court hearing in respect of getting him evicted had taken place. His dad had attended on his behalf, and would have been made aware for the first time that my OH is a complainant in the case (until then they will only have known about the lady next door who has the injunction against him).
- Someone has been living in his flat whilst he's in prison, and whoever broke in has gained access to my OH's flat via the kitchen window, which is round the side of the building, next to upstair's flat's front door and looking out into their garden.
- Upon entering the flat, they have been in every room (evidenced by the blood smeared on the walls) and have trashed the bedrooms (they even went through our laundry basket). And yet, despite having been in the lounge, they didn't steal the widesreen TV or computer in there. In fact, they stole nothing. To me that seems like someone wanting to upset us, rather than a random burglary.

Luckily I have my own flat (in a gated development in a nice part of town!), so I'm not living there full-time. We kind of split our time between the 2.
I am intending to move in there in the new year though, but will be very reluctant to do so if the d!ckhead upstairs is still there. As it is I don't even want to stay there atm and am especially scared to leave my car parked outside.:(
It's just appalling that someone who's rent is being paid for by the state, can cause so much distress to people who are working hard to pay their own rent, or who have worked hard to buy their home, like my OH.0 -

I know that there's the whole ghetto argument, but I really don't see why people who want to behave like that shouldn't all be housed together in sh!tholes, where the only people they can terrorise are people just like them. You could perfectly legally make his life pretty awkward.., even if he's absent (in prison). If his garden is a mess, call environmental health. Don't mention he's in prison, and with any luck someone will answer the door when they knock, and then u'll have weak proof someone else is in the flat (although I am sure they will say they were just 'visiting' or making sure it is ok in your neighbours absence). But any hassle has to be good lol. Just keep making phone calls, I'm pretty sure u don't have to live in the flat below to call environmental health.0

This is practised where I live, albeit covertly. It is all engineered to ensure you have to be wealthy to live anywhere but certain areas. There is no chance of rich people ever living cheek by jowl with poor people on benefits. There will never be a block of flats next to someone's posh house.
It makes a very odd society. When something happens that brings you into contact with the other sections of society, you realise you're living in an artificial apartheid bubble.0
