estate agent - very poor service

    The thing i can't get my head round is that the house has been on market for 14 months with this EA & they still expect you to pay a fee if you withdraw or move to another EA. In my experience of EA's the contracts i've signed have always been for 12 weeks, after which you can change agents without any fee to pay, only if you withdraw in the first 12 weeks do you pay a fee.

    Sounds like pretty poor contract terms & personally i'd never go near an EA that expected to be paid something even if they failed to sell my house.

    does it say in the contract about the fee? I wouldn't be willing to pay for something that I didn't get tbh.

    withdrawal charges
    "if the agency agreement is terminated by the agent or the client, or the property is sold other than in circumstances entitling the agent to a fee as stated in these terms and conditions the client will pay to the agent a withdrawal charge of £150+vat. this does not affect the clients rights to withdraw or withold payment where the agent has failed in his obligations and responsibilities to the client under this agreement"

    the fact that they only sent time wasters round and didnt bother checking the financial posistion first as instructed from day one by myself, and the lack of comunication and fact they withdrawn the house without telling me or given a explanation as to why would i have a case against the "failed in his obligations and responsibilities to the client"?

    if i thought they had given the sale a honest go i would just take a cheque in today and pick a new e/a but they have been so poor dont feel obliged to just hand a cheque in without letting them know how poor they have been

    Take the property off with them. Write a detailed letter to the MD explaining how poor that you have felt the service is, and that you had given them more than enough chances to sell it.

    If you get a negative back from the MD, and you still feel agrieved to pay, then right another letter, telling them that you will write to your local rag and that you will be putting a negative review on www.allagents.com.

    Other thing to bear in mind though as well is, 14 months marketing for them, they are going to be out of pocket for more than £150, its not the worst withdrawl fee i have ever heard of.

    gah- just looked at www.allagents.com they have 6 branches and only one shop is on there with 7 good reveiws and no negative the shop i dealt with has no reviews, think i will just pay them and put it down as a bad experience
