====================================
Dear Sir/Madam,
I wish to appeal against a decision made by Nationwide Building Society regarding my complaint against the miss-sale of Payment protection insurance.
My complaint with Nationwide was that I made an application for a personal loan without the insurance. During the course of my application, a lady from Nationwide personal loan team called me at my place of work.
She indicated that as my requested amount was large for someone of my age, I would not qualify for the loan unless I took the insurance. I did say at the time that I did not want it and that I was in a very secure job, but took it as I was not given an option.
I made these points in a recent letter to Nationwide and after a lot of correspondence; I received a letter from them rejecting my complaint.
The letter is lengthy and I enclose a copy. My interpretation is that the letter gives the following points:
I also feel I did not indicate I was happy with the cover by not complaining. I made it clear in my conversation I did not want it. I am raising a complaint after 12 years because I did not realise that it was an option until recent media coverage.
I would also like to draw your attention to the last paragraph on the first page of the rejection letter (I enclose a copy along with other relevant correspondence including the original loan agreement)
It says that the:
‘loan amount was above the maximum permissible amount that we could offer, however there is nothing to suggest that you were not given any choice in respect of loancare cover or told you would not qualify for the loan unless you took this option’
and also:
‘the representative indicated it was vital for the loan to be backed by insurance’
I feel that these two points are a complete contradiction and in fact back up my given reasons for complaint.
I would be grateful if you could now investigate the matter further, as I feel that Nationwide have exhausted my complaint and indicated that this is their final response.
Should you need any more information from me, please feel free to contact me on the above details.
Yours sincerely
Mr Jamie Pullen

The letter is lengthy and I enclose a copy. My interpretation is that the letter gives the following points:
- I was eligible for ‘loancare’ cover
- I was given sufficient information to ensure the cover was right for me
- I proceeded with the loan and took 12 years to complain, indicating I was happy with my cover.
I also feel I did not indicate I was happy with the cover by not complaining. I made it clear in my conversation I did not want it. I am raising a complaint after 12 years because I did not realise that it was an option until recent media coverage.

Hi
This is a fantastic letter and well put together, well done!:T
However, the FOS may also expect you to complete the FOS complaints form (if you have not done this yet), more details of this posted below, but there is no harm in enclosing your letter within the form, the very best of luck.;)
