Car accident/Insurance help please!!!!!

Hi folks,

Was in an accident with a Motorbike 2 weeks ago. The motorbike tried to overtake me on a narrow road and collided with the side of my vehicle. At the time the biker was apologetic.

My insurance company was happy that I was innocent and took my car for repair, gave me a courtesy car and I have not (yet) paid any excess.

Now, he has changed his mind and decided it was my fault. I has a letter from his insurer this morning, advising they are seeking damages from my policy and they are satisfied I am at fault.

I have emailed my insurance company a google satellite image of the scene and superimposed the vehicles and collision site. I have also emphatically stated that I reject the claims of the collision being my fault. I have not yet received a reply though.

Is there anything else I can do? I am away next week and am worried they may decide to settle in my absence. I don't want to wreck my break worrying about this.

Any advice would be very much appreciated!

    Nothing much you can do really, you just have to leave it in the hands of your insurance company I would think.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    Unless it's a rear end shunt, the ins companies will always deny liability in the first instance. Don't worry about this yet......

    The ONLY thing he could possibly say is that you swerved into his path, whilst still relatively rare, it is becoming more common with the British "queue mentality" for drivers to attempt to "block" bikers overtaking them.

    The rider was overtaking and should have ensured it was safe to do so, unless he's got a helmet video camera (becoming very common these days), it's a fairly straight forward claim which you can't lose.

    They cannot settle a claim in your absence AND as long as your insurance has legal cover, this should not cost you a penny (except for the rise in ins premium next year, that will happen no matter who wins.)

    Speak to your insurers and tell them about the letter. They will probably say to forward it on to them and no need to do anything else.
    The biker apologising is as good as admitting fault in the eyes of insurers, especially if you have a witness to it.
    I had a very minor car shunt which I knew was my fault. We exchanged insurance details and feeling a litle guilty but aware you should never admit fault, I said to the other driver, out of earshot of her passenger, that I was sorry her day had been ruined. Nobody was hurt, no airbags deployed and the damage was very light.
    Some time later, I got a letter from some solicitor representing the third party asking me for details of my insurers as she was claiming for whiplash injuries (of course!), I had admitted fault at the scene and she had a witness to that. My insurers said to do nothing but forward the letter to them and they'd handle it. That was the last I heard of it.

    Its such a nause dealing with these things. I am still waiting for the insurance company to respond to my email. Going to pop a copy in the post recorded delivery I think!

    I would also put in a claim for the increased insurance costs that you will have to pay for the next 3/5 years.

    I had a motorbike tried to overtake my GF while she was turning at a crossroads ( which in fact is against the highwaycode ) and I ran a couple of quotations and the premium went up when I added a non fault accident !

    Shocking how YOU will pay more on your premiums if you have a non fault accident.
    "Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!
