Just a little update on this. I wrote to the original manager in Customer Complaints and another "manager" wrote back saying the internal cheque had been raised and they were waiting for it to clear. Essentially she was admitting that Complaints & Collections didn't know what each other were doing. However what she failed to answer completely was had they registered a default notice against me? How can I insist they divulge this information and how do I get them to rectify it if they have? I feel I'm being blackmailed here by the bank simply because their hand was forced into a small write off.0

The only way to be certain is to wait a month, then get hold of your credit file. If they put the default on there, which would be a bad thing cause you'll be s*****d for 6 years then you'll have to write to them insisting upon its removal.0

If they've not explained either why the departments aren't communicating or whether the default notice has been cancelled, I wouldn't let them close the complaint. If necessary, escalate it to the FOS. It's about time Santander itself received a default notice0

Low and behold I am in receipt of my credit file from Experian and guess what? There's an entry on there from Santander. Status History 8 (account is in default). As they say in panto land "Oh no it isn't"
I have TWO letters from Santander stating they would not lodge a default.
What is my next appropriate course of action? Do I simply write to Experian and ask for the entry to be removed? They say you can send them supporting documentary evidence.
Or should I complain to the Ombudsman about their bad and inappropriate banking practices? Surely there are banking laws governing incorrect information being lodged with third parties which is detrimental to my financial status?
Any pointers greatly received.0 -
Hello,
You will need to get your reports from all 3 agencioes (Experian, Callcredit, and Equifax) to see who has recieved what information.
You can register a siapute with the agencies, and can include any evidence which confirms that the default is in error. They will then liaise with the data controllers at the bank to get the entry corrected.0 -

You need to ask Santander to remove the default as they are the only ones who have the power to do so.
If you don't succeed with Santander go down the Ombudsman route.0 -
One more letter to Santander (Try their Data Controller), giving them 28 days to correct your file. Tell them you will go to the Ombudsman if they don't update it. Include all correspondence from them with your letter. Send it recorded delivery. Then follow up with the Ombudsman all the way if they don't sort it out in 28 days time.
The CRA will not act on what you send them without the agreement from Santander.
Then go find yourself a proper bank ;-)0 -
Update:
Contacted Experian who in turn contacted Santander to query the entry. Waited several weeks for Santander to get back to Experian to tell them "the entry is correct".
Experian have added a note on my behalf saying *entry is in dispute*
Sending off a letter to the Data Controller at Santander now.Beggars belief haha.
