Hi Peeps
I need a bit of help / advice. I tried to return a faulty tv to comet to day (the sound has gone again) I was armed with the receipts & SGA details 6 years return policy.
I was polite & advised I need to return the faulty goods. I was not greeted with a hello. The customer NOT service informed me that I couldnt return it. We brought the tv 2 years ago, it was replaced 6mths after it was brought for the same reason no sound. Again it has the same issues. I was going to give them the SOGA to read & they snotty replied we know what it is & as you havemt brought extended warrenty I cant havea replacement. I began to read the infomation but again they were having non of it. At this point another customer NOT service person tottled up & informed me "Im doing law at uni & its not 6 year"... well good for you love. I felt a bit ganged up on as now 3 of them behind the desk trying to get involved
I was then rudely informed that I would need to contact the headoffice. I advised that if they contacted them I would speak to them on their phone. Surprise on a sunday they ar not open. I asked to speak to the manager & again he was rude & didnt want to read the SOGA that I brought with me. Instead he informed me I had to pay to get it tested. Well if they bothered to switch the TV on they would notice NO SOUND. i must point out that the tv is hardly used, in excellent quality, no scratches, clean etc. He then walked off.
I asked for the head office details & names of everyone that spoke to me. I left the tv in the shop.
I have emailed the CEO rather then ring normal customer service as in the past we just get fobbed off.
What i want to know has anyone else tried to return anything under the 6years ruling & am I right

Mmmm bet they gave a big sigh when you left the shop.
You are confused somewhat. The sale of goods act states that you have up to 6 years to make a claim. This doesn't mean the product should last 6 years just that you have this amount of time in which you can take it to court.
Up to 6 months the retailer has to prove it isn't faulty

You need to read the sticky at the top of the page which will provide you with a layman's guide to SoGA.
SoGA is not 6 years, but "up to" 6 years. After 6 months, it is the consumers responsibility to demonstrate that the product was inherently faulty at the time of purchase. You can do this by providing an engineers report.
It may cost you to commission a report, however the cost of the report can be recovered from the retailer if it finds in your favour.

As things stand, they are quite correct in refusing to remedy the fault free of charge. You need to obtain an independent engineer's report detailing the fault, and its causes. Then submit that to their customer services, and they will offer whatever they see fit, probably a repair.Squirrel!If I tell you who I work for, I'm not allowed to help you. Please read the SOGA from start to finish.
