Amazon Marketplace Sellers

My mother bought a Panasonic TV 4 months ago - from a Amazon Marketplace vendor - which I have since found to be faulty in that the HDMI port is not functioning. She tried to contact the vendor via the usual Amazon channels...TWICE and got no answer. On filing a claim with Amazon, according to their A-Z guarantee, she met a wall of resistance.
She was not entitled to any recompense/replacement from seller, as fault had been discovered after a 14 day cut-off point.
She was not able to elicit any details about seller from Amazon as they operate a privacy policy.
Amazon have closed the case and denied her claim, maintaining that she must contact seller to resolve this issue, a seller who is anonymous...thanks to them: A seller who refuses to answer her emails.
On contacting Panasonic she was told that a replacement TV can only be provided by seller, their manufacturer's warranty covers repairs only.
Moral of story: Don't buy from ANY online agency which enables seller to operate behind a screen which protects their dishonesty and denies YOU your rights.:mad:
Totally ignore the reassurances of the Amazon A-Z guarantee, as it barely seems to cover A-B.

Was the seller a business?
If a product is less than six months old and develops a fault it is up to the retailer to prove that the fault was not present at the time of sale. If the seller is being unresponsive you would have to pursue a claim via the small claims court.
Amazon does have a privacy policy but under the Data Protection Act they must disclose details if they are necessary in the pursuit of legal action - there is a specific exemption for under the DPA for this. Send them a DPA request quoting the exemption and they must reply - include in your letter that you will complain to the information commissioner if they fail to respond. The relevant exemption is in S35(2) of the Act.Common sense?...There's nothing common about sense!0 -

Op even if you did manage to contact the seller he/she would have the right to have it repaired anyway. Best just to cut out the middleman and go straight to Panasonic for the repair, this would also save a lot of time as they can turn it round much quicker than the seller.0
