TERMS AND CONDITIONS

Prize Draw for a trip to Ibiza for two people.
MEDWINDS DESING SLU, hereinafter MEDWINDS, with fiscal number B57669590 and residence at Ctra Alaro-Consell s/n Finca Son Forteza 07340 – Alaro, Balearic Islands (España), organises an action to promote its products that will be governed in accordance with the following rules and regulations.
The draw will be promoted on MEDWINDS' various websites. Participants can win a trip to Ibiza for two plus an exclusive programme of activities.
In order to take part it is necessary for the participants to sign up to the pages that will be made available to them for the competition on MEDWINDS https://www.medwinds.com
1. SCOPE, PUPOSE AND DURATION
Participation in this competition is free.
The purpose of this prize draw is to promote our products and MEDWINDS' websites.
The competition will be launched on the 16th of June and will end on the 31st of August 2011 at 23:59 hs. The draw will take place on the 2nd of September 2011. The draw will be carried out by Medwinds staff that will choose the winner and ten runners-up at random.
The trip will take place from the 16th to the 18th of September 2011.

2. PARTICIPANTS
The draw is open to all persons over the age of 18 who are residents of the European Union.

3. HOW THE COMPETITION WORKS
In order to take part, visitors on our websites (e-shop, official Facebook pages and blogs) have to register as clients https://www.medwinds.com, in the section belonging to the prize draw, and follow the steps indicated there in order to participate.
Participation in this prize draw is articulated via the web https://www.medwinds.com, the participant should complete the personal data required by MEDWINDS (name, email, date of birth and gender) and accept the terms and conditions of the prize draw.
The data provided must be genuine. Participants promise not to engage in any speculative or profitable activities. Only one registration per participant is allowed.
4. COMMUNICATION
MEDWINDS will publish the promotion and the instructions necessary to take part on its official Facebook pages, online shop and blogs.
5. PRIZE

The trip must take place on the days 16th and 17th of September 2011. Under no circumstances can these dates be modified.
This prize is personal and non-transferable, not exchangeable for its cash value or products, nor can it be substituted for any other prize of its equivalent value.
The prize winner will be notified within 5 working days after the draw has been carried out via email and the result will be published on our blogs and MEDWINDS official Facebook pages.
If the winner does not confirm within 10 days of Medwinds' notification, he/she will lose the right to the prize, which will be passed on to the first runner-up automatically. In the event that Medwinds does not receive confirmation from the first runner-up, the prize will go to the next runner-up and so on successively. Should Medwinds not receive confirmation from any of the runners-up, the prize will be considered null and void.
Declining the prize does not grant the winner any rights to damages or compensation of any kind. In the event that the winner does not make use of the trip, this act will be understood as relinquishment and therefore the aforementioned conditions will apply.
In the event that the prize-winner does not meet the requirements stated in the terms and conditions, participation in the promotion will be considered invalid. In said case, the prize will automatically go to the first runner-up and so on successively until the 10th runner-up in strict order. If neither the winner nor the 10 runners-up meet the requirements established in the terms and conditions, the prize will be declared null and void.
The winner must disclose all their personal details, name, surname, full address, email telephone and passport/ID number. These details must be genuine.
In the event that neither the prize winner nor the runners-up can be contacted within the established time period the prize will be considered null and void.

6. TAX HANDLING OF PRIZES
The prize, payable in kind, will be subject to payment against IRPF (Income tax) and is calculated by applying the percentage of 19% to a taxable amount configured by the result of incrementing the purchase price or cost of the prize for the payer by 20%; all this in accordance with the articles 101 of Act 35/2006, and 99and 105 of Spanish Royal Decree 439/2007. If the stated taxable amount should not exceed 300 euros the prize will not be subject to payment against income tax in accordance with article 75 RD 439/2007.

7. DATA PROTECTION
The details of the official Facebook page members, participants and the winner will be used for the correct running of the prize draw.
The personal data disclosed will form part of an automatic database managed by MEDWINDS DESIGN SLU, for the purpose of managing this aforementioned promotion and to send commercial offers that may be of interest. If you are not interested in receiving commercial offers, or you wish to access, modify or cancel the details on the database, please send an email with a photocopy of your ID attached to: social.media@medwinds.com

8. IMAGE RIGHTS
The winner and participants in this competition expressly authorise the organising company to reproduce, use and publish their name, surname, image and voice in any publicity and/or promotional activity related to this competition, in any media, including internet, posting photos of the prize winners, without these said activities granting any rights to payment compensation or benefits of any kind with the exception of the prize won according to the terms and conditions here stated.
Otherwise it is understood that they relinquish the prize.
9. GENERAL CONDITIONS
By the mere act of taking part in the aforementioned promotions, the participants, and people who receive the prize or benefit from the same, accept the terms an criteria laid out by MEDWINDS with regards to the resolution of any incident that may arise.
No employees of the Medwinds group or their family members are allowed to take part. Neither can the marketing or advertising agencies nor the suppliers related to the promotion.
In any circumstance that MEDWINDS or any entity professionally affiliated to said promotion detect any kind of anomaly or suspect a participant of obstructing the normal procedure of the promotion, they are authorised to delete that participant's inscription unilaterally.
MEDWINDS reserves the right to modify, if deemed necessary, the conditions of this prize in exchange for another of equivalent or superior value.
Participants with erroneous, false or incomplete data remain excluded from this promotion.
Medwinds reserves the right to avoid this promotion becoming subject to profitable or speculative systems, in which case, can take the legal action it deems necessary.
For the purpose of settling any discrepancies that may arise, the rules and regulations stipulated in these here terms and conditions will be adhered to with the strictest rigour; the organisation's criteria, interpretation and implementation prevailing.
Any cause for dispute that may arise regarding this promotion will be subject to Barcelona's City Courts.
Participation in this promotion supposes the complete acceptance of the present terms and conditions.
