Now what?

I sent the template letter to the RBS asking for a copy of the credit agreement and terms and conditions. I enclosed £1 as required and asked them to respond in 12 days. The time has elapsed and still no response. What should be my next course of action?

    I would give them a ring and chase them up.

    I would like to mention though, even though it's useful to have the agreement, but if you have the account number, and know you were sold and mis sold PPI, you can still go making a reclaim.;)

    I did the same but with Natwest who are part of RBS. I was told I had to send a cheque to RBS for £10. I received a letter from them after about 2 weeks and they said I as stated in the Data Protection Act 1998 they are given up to 40 days in which to respond!!! I still put my complaint into Natwest back in May but still would like the agreement for my records.
  • Well I've now got a reply, but I'm more confused than ever! They (RBS) say that the credit card agreement has been 'misfiled' ...do they mean 'lost' or do they mean 'we know you are trying to get cash out of us, and we don't want to find it'? I can only speculate...
    Anway in the letter to me they say that as they are not able to enforce the agreement until such time as we (RBS) are able to comply with Section 78 they have , with immediate effect, reduced my credit limit to £350 ( it was £6,600) They also sent back my cheque for £1. Any thoughts on what I should do next?

    We refer to correspondence dated 10 September 2011 and apologise for the delay in our response.

    We regret to advise that the card agreement has been misfiled and despite searching our records we have been unable to locate it. As we are unable to comply with your request we return your £1.00 fee.

    In the circumstances, we accept that we are not able at present to comply fully with your request made under section 78 (1) of the CCA and therefore, pursuant to section 78 (6) of the CCA, we are not able to enforce the agreement until such time as we are able to comply with section 78 (1). In view of this, it would not be prudent to allow further spending therefore with immediate effect we have reduced your credit limit to £500.00.

    Although the Credit agreement is currently unenforceable, the credit agreement is not void and your obligations to make payments to us under the credit agreement remain. Please note that if we do not receive payments on the account as requested on your statement, as per the terms of the card, we may take such action as is legally permitted to pursue the outstanding debt. We will also issue and register a default should repayments not be made as agreed.

    Why have they reduced your credit limit and make the statement in the last paragraph of the letter. Did you just ask for a copy of your original agreement?

    Yes, i sent a letter to them asking for a copy of my credit agreement with a view to reclaiming my PPI.

    I was also a bit pi**** with the last paragraph because i've had a my credit card with them for over 15 years and i clear my balance every month.

    I'm expecting similar treatment then, as I've just sent off a SAR to them. If I receive a similar letter, I will have great pleasure in replying to tell them where they can stick their card and close the account. I don't owe them anything either but over the years they've taken hundreds if not thousands from me in PPI, and I intend to fight them to the last to recover it.
