insurance settlement recieved.....then retracted????

hi all;

i made two claims on one trip on my travel insurance, (Global claims Services), for which i recieved two settlment letters and a promise of cheques for each to be posted seperatley. the following day i recieved only one cheque. one week after recieving the settlement offers (and 1 cheque) i recieved a letter telling me that the second claim had been rejected on grounds not mentioned in first settlement letter!!

basically my question is, can an insurer backtrack on n offer once the have sent a formal indication that it is settled and promised delivery of payment? and if so on what grounds?

in this case no new information was available after the settlement offer was made nor did any circumstance change and they claim that the original offer was an 'error'. ? ? ? ?

    Anyone can "backtrack" in the event that an error has been made.

    Ask why your claim has ben rejected and if the answer is unsatisfactory then appeal the decision and if you are unhappy with the outcome of the appeal then use the complaints procedure which will be set out in the policy to escalate the issue (all the way if necessary).

    at what stage then is an settlement final then? the thing is i have went and bought a replacement item for the one lost, having assumed, reasonably in my eyes, that the cheque from the insurance company was pending as explicitlly guranteed.

    the reasons given when i have asked them is the same as those on initial settlement letter as to why i was recieving only partial payment for what i had claimed for. (at this stage i wasnt exactly happy but accepted the partial offer) however it is quite clear on the first letter that some payment is still due, and full break down, exchange rate details etc are provided

    If they "guaranteed" you the payment you have good grounds to appeal their decision, pointing to the guarantee.

    Then if they reject the appeal follow the complaints procedure all the way till you get satisfaction.

    this is letter wording


    'we are pleased to confirm that a cheque int he sum of £xxx, in full and final settlment of your claim, will be sent under different cover'

    seems pretty straight forward to me

    Well....they don't actually "guarantee" you the money.

    But follow the advice regarding appealing their rejection of the claim.

    perhaps not guranteed although i can't see how it could be intreprated as anything else but an intent to pay, anyway hopefully you can understand my shock at the turnaround
