Insurance Question

Comments

  • Thanks guys!

The street is very narrow - cars are always having their side mirrors knocked off etc.

ultimately it is my fault - my son opened the car door as he was driving past. he had no room to do anything else.

My campervan did not receive any damage.

My main car is Ford where I use my ncbs
my 2nd car is camper - social use. Both are on seperate policies with different companies.

Direct Gov verses a little driving school, very contradicting. Personally I believe it should be common sense, i look when i open my doors and my car has child locks and use them as they were intended.

Your insurance policy conditions do require you to notify both your insurers of the incident now and any new ones in the future (when asking for a quote they usually ask about your history up to the last 5 years).

If you fail to do so then you give them grounds to void your policy at any time they choose to in the future should your non disclosure come to light (and it will if the third party has complied with his insurance policy and notified his insurer - all incidents are held on the CUE database)

Was there room for the other car to drive past outside the range of your camper van's door?

    If so, it's their fault.
That's rubbish. It is the kind of thing an idiot who's just doored a cyclist would say.

The Highway Code says you should try to leave a door's width between you, but that does not mean you are to blame if someone opens their door and you hit it.

Sorry, but that is not the case. Whilst it is a good idea to give clearance when passing stationary motor vehicles the occupants of the vehicle still have a responsibility to open the door when it is safe. There is a specific offence of opening a door to danger.

OP, just phone your campervans insurers and tell them you are making a claim. I cannot see why claiming on one ploicy should affect the NCB on the other.

It doesn't have any affect on any NCB earned on other policies.

But all insurers you are with have to be informed of all incidents. (As do all other policies where you are not the policyholder but a named driver on the policy)

That's one I haven't heard before, don't suppose you have a link? and even if such a specific offence does exist, does it apply to 18 month old babies?

OP...... not withstanding the above I have doubts about whether you are legally (rather than morally) responsible for the actions of an 18 month old and if you aren't then the question arises whether your insurance company will pay for a moral rather than legal obligation on your part. My gut feel is "no" in both cases

I think if I were you I'd get some legal advice before doing anything

Yes, and it would still legally be the cyclists fault for riding too close to the parked cars, just a lot harder to claim from them.
    Wrong.

Sorry, a friend wearing a bright yellow jacket was hit by a stationary taxi driver opening his door in front of her whilst she was cycling by and he was fined for causing the accident. Currently waiting for the outcome of plastic surgery to complete her claim for damages.
