Managing Company not collecting money for sinking fund

  • Hi Carine, I am very interested in meeting to discuss this further i own one of the properties in the building. i am very concerned about this bill for works. I do not know any of the other leaseholder but have drafted a letter which I will put on the noticeboard to see if I get any responses. Please PM me.

    Hi Reens,

    I responded to your email last night and will today post a letter to all leaseholders regarding this so they can get in touch with me.

    I have received a response from the Managing Agent regarding my queries, they have responded to all items (unsatisfactorily to most items) apart from my question as to why they have never set up a sinking fund for our property since the lease requires it.

    Please refer to this document from LEASE, page 5, about reserve funds. This is the only way to deal with major works and the Management Company have failed to meet their obligations in this matter.

    I have requested the estimates as well as a detail of the works planned. I have also received a response for the RICS who are investigating the MA's lack of correspondence and generally poor service.

    These works are necessary and we will all have to pay more for service charge in the future which is unavoidable as the building is in such a state of disrepair, having not been maintained for years however I believe that billing us for such a large sum is unlawful, inadequate, and unfair.

    The only way this can now be resolved (since the invoice is due soon) is for us to apply to the Residential Tribunal Service (formerly the LVT) to investigate. This needs to be done quick though.
    I will organise a meeting for next week. Hope you can attend.
