Personally i think people like the OP are bad seeds. They sign up for a hotel where they are told they have to pay a £10 per person non-refundable deposit for the hotel rooms. They knew at the time of booking if they cancelled the rooms they would lose £40, they are now just trying to get out of paying this £40 because the deposit was taken after they cancelled the hotel. Technically they may get away with this, however in reality they are obviously a bad person.

If they had taken the £40 deposit at the time of booking and informed me it was non-refundable then i wouldnt have even grumbled as it's my fault. However i don't agree that you can just change T&C whenever they feel like it. I have only cancelled as my partner is having to have an unexpected operation next week and won't be in a condition to go away for the night!! But have they actually changed them?
All they stated was that a £10 per person deposit may be taken, but they didn't stste that this would be taken at the time the booking was made.
I, along with most people would assume that the deposit would be paid at the time of booking, but the hotel concerned didn't actually state this.
Why not contact the hotel again and see if you could book a room for sometime in the future (when your partner has recovered), and ask if they could put the deposit towards this.0 -

No you are a bad person for trying to get out of paying the money you agreed to pay at the time of booking. Why should the hotel lose out because you are no longer going? Unexpected things that happen are never nice but if you don't protect yourself with insurance then you should take it on the chin and pay what you owe.
As i have said, i wouldn't grumble if i was aware of it. I was told no payment would be taken from my card. So i haven't agreed to make any payment at the time of booking, i was advised i could pay the full balance on arrival. Personally i feel i have given enough notice for the hotel to find someone else to occupy these room. Especially with it being the height of season.
I think i'll end the discussion there if it's going to turn nasty!

Op, as in life there is always the odd person who, faced with the possibility of losing an argument, will try to save face by resorting to personal insults. Forums like this often attract them for some reason.

I'm not ashamed of myself at all. The OP is trying to weasle out of paying what they agreed to pay at the time of booking.
Its not the hotels fault he couldn't be bothered reading the T's & C's. These days this is less a consumer rights protection forum and more a forum to provide people with loopholes to get out of paying what they should rightfully pay.
Besides you say I have lost the argument but at the end of the day the OP has lost the £40 so technically I have won the argument as I am on the side of the business that is currently winning the dispute.This is a system account and does not represent a real person. If the terms and conditions are poorly drafted / not given at the time etc. why should they pay? If contracts are not properly constructed it is not a loophole is it?? It is a shop being useless / lazy / ignorant of the law.
It's hardly a loophole using a companies own poorly written contracts against them!
You were pretty harsh saying someone was a bad person wanting to get their money back from the company.
Despite what I say above I am in agreement with you. The T&Cs were clear that £10 could be taken as a non-refundable deposit prior to stay.
Even though it is at cancellation it is still in advance of the stay and therefore to be expected. However, IANAL and two of them on here disagree with me so I will defer to the experts!Thinking critically since 1996....0
